Hurley, Taylor and others and Mc Ki) ontorod into a contract of ar rangoment by which McKay was to convoy tho lands to Enritjuo Taylor, who was to borrow a largo sum of money from capitalists in tho City of Mexico on tho lands, which ironey was to bo divided up bo tweon McKay and Messrs. Hurley, Taylor and others, and tho land was then to bo reconvoyod by Taylor to McKay, one-third of tho lands to bo ested in McKay and tho balanco to bo convoyed to him in trust for tho other parties. This de d of convoyanco was executed in dupli cate. Up to this time McKay was in possession of tho hacienda, con trolling tho samo, and it seems that everything was amicable and under stood betwoen all parties; but tho largo loan on tho land which was to bo negotiated by Taylor in tho City of Mexico failed to lnato-ializo, and whon Taylor failed to got tho money and wanted to have the deed recorded which had been executed to him by McKay tho trouble began. It was necessary in ortlor for tho deed to bo recorded that McKay should givo his consent thereto be foro tho officer whoso duty it was to rooord tho instrument. This ho re fuaod to do until tho deed of recou vovanco from Taylor to himself hail beou delivered to him, such deed of reconveyance having been left ii Taylor's possession in Texas. From some cause Taylor did not deliver tho deed of reconveyance to McKay, and thtreupou M.'Kay returned to Texas and obtained tho duplicate deed of such reconveyance, whioh had been executed by Taylor. Whon this wa3 done Mossrs. Hur ley, Taylor and others filed suit bo fore tho Judge of tho First Instauoo at Tuxpan for possession of tho hacienda, against tho original lessoo of tho promises, whom Me Ka had bought out, anil from m honi ho had taken an assignment of tho lease. But McKay was not notitiid of tho suit, and had no htarinc before the court, Messrs. Hurley, Tuy.lor and others claiming that McKay was a tenant of tho pa-t whom they sueel and was bouud by tho judgment rendered, notwithstanding ho had no notico fiom the court. Judgment was rendered in tho and instructed Minister Cray that inasmuch as the matter had gone into the courts in Mexico tho rights of tho parties could b- properlj ad judicated atid bottktl, and that there was no need of further inves ligation by tho department of state. Afterwards M Kay employed attorneys and lilul suit against Hurley, Taylor and others for possession of tho entire hacienda and to establish his right to such possession, which nut wa tried a few days before tho shooting of Lewis occurred, and j idgmont rendered in McK iy's favor, establish ing his ownership and right to possession of tho premises, and ho was placed in possession by the jadioial authorities. Then it seems Lewis returned to tho hacienda at night, and ho and young Perry MjKiy met and ha 1 an altercation, in whioh hard ortia ptused betweon thorn and which ended in each drawing his piitol. Perry McK vy fnod first and shot Lewis in tho head, tho pistol of Lewis failing to lire. Lovh w:h only shot once, and was placed m the hospital, under guard, under a chargo of assault with intont to murder, until ho recovered from his wounds.
