The occa sion for the closing down of all booze industries is the going into effect of the new law forbidding the manufac ture of intoxicating drinks within the borders of the. state. Violation of Forgotten Piovis ion of Charter Seems to De clare City Offices Vacant. IS ALL-ABSORBING TOPIC Mayor; Commissioners and the Heads of Departments'May Be Holding Office Illegally. •r«rial Diapstck. Austin, Tex.. Dee. 31.—Through the unwitting violation of a forgotten pro vision of the city charter there is a possibility that every city official in Austin, including tne mayor, commis sioners and head* of the various depart ments, is occupying hi* office illegally. The question is raised by tho Business League and ia the all-absorbing one in Austin officialdom. A provision in the charter prohibits any city official* receiving from any publie service, eor|>oratioii or company, service for a rate lower than the one the general publie is required to pay. The provision further states that a vio lation of thia section will make the of fice of the violator, ipso fncto vacant. When the Southwestern Telephone company was granted its franchise it offered to supply a telephone in the city offices free of charge and to grant a reduction of 23 per cent on any phones which the council might authorize. Re cently this offer in the franchise was brought to light and Alderman John son introduced n resolution that tele phones in the residences of city offi cials be paid for according to this pro vision of the franchise and the resolu tion was passed. By this action the council and city officials laid themselves liable to the provision of the city charter which de clares their offices vacant for violation of the section mentioned above. No official action has been taken on tho matter, but the discussion is heated and legal lights are puzzling over the quesiions involved. Evansville, Ind., Dec. 31. —Many Ohio river towns have not had mail for three days and some of them are suf fering from short food and coal sup plies. Old river men say that not since tho civil war has the river been so heavily blocked with ice and it is estimated sus pension of navigation on the lower river will cause a loss of $lOO,OOO. This does not include possible immense damage to property when the temperature gees up and the gorges begin to break. San Francisco, Dee. 31. —By 20,000 majority the city voted municipal own ership for the Geary street railway, and voted $2,000,000 in bonds for the purchase and construction down Mar ket street to Ferry. This will destroy the United Railway's monopoly on Market street, and is the result of a bitter campaign wfiieh has been agitat ed for several years. Associated Press New York, Dec. 31.—Belated Christ mas packages and other ynhmblc ex press shipments in large numbers went up in smoke today in a tire, which de stroyed the American Express com pany’s office and store rooms near the Grand Central station, causing a loss estimated at $500,000. Two men were bndly injured. The Adams Express com pnny buildings, near by. were threatened but hard work by the firemen saved these structures. The greatest danger from Influenza is of its resulting in pneumonia. Mass., Dee. 31.—Thirty five hundred conductors ami motormen cm ployed by the Boston Elevated Rail rond company received a New Year’s gift today from the company of $2O and $25 in g«ln as a reward for good records in 1909. The company distributed this year $75,000. the largest sum ever given since the custom Was inaugurated seven years ago. ELEVATOR BOY FALLS 4 STORIES TO DEATH Harry Baker, 19 years old, employed ’ ns elevator boy at the St. James hotel, fell through the elevator shaft from the fourth story last night at 10:30 o’clock, sustaining injuries from which lie died a few minutes later.
