CHARGE TO GRAND JURY
BASIS FOR NEW TRIAL
Judge Dwyer's last charge to the I
grand jury, in which he commented on
the prevalence of crime in San Anto
nio aud urged the inquisitors to do their ■
utmost to stamp it out. is advanced as a
reason for a new trial in the case of
the State against Ed Powell, recently
convicted of robbery by assault on .1. C. ।
Hawkins, an aged man, who says he was |
beaten and robbed.
Attorney Leo Tarleton, counsel for
Powell, sets up in his motion for a new
trial tiiat Assistant District Attorney
<'. M. Chambers, in his argument to the
jury which convicted Powell, read from ]
Judge Dwyer's charge to the grand
jury that particular paragraph which
dwelt on the prevalence of erime and
the necessity for its suppresion. ami,
that this was an undue invasion of the
jury box and calculated to prejudice
the jury against the prisoner. Attor
ney Chambers is also charged with hav
ing asked for a conviction in order to
sustain the district attorney. Other
charges are also advanced as a reason
for giving a new trial.

“I believed in Dr. Cook as a
man who had faith in himsell,
when I first saw him ragged,
filthy and with two front teeth
gone, in the cabin of the ship Hans -
• Egede, which bore him back to civ- 1
ilization,” said Sten Drewson at
the Gunter hotel today. Mr. Drew
son was connected with the Politi
ken. the leading paper of Copen
hagen, and is as well-correspond
ent for the New York Herald, and |,
not only was he the first man who
met and interviewed Dr. Cook on
his arival at Copenhagen, but his
was the story flashed over the
wires and gave to the entire world
the greatest sensation of the coun
try.
When the news first reached Copen
hagen that Dr. Cook was heard from
Mr. Drewson declares he felt he would ।
be the first man to reach him and get J
his story. Accordingly he planned with
his editor to go out on a pilot boat to
meet the Hans Egede. Despite the fact
that he was warned the pilot could
never stop the ship so that he might 1
board, Mr. Drewson persisted. Armed!,
with a telegram for Dr. Cook from
James Gordon Bennett of the
York Herald, he went out 24 hours end
aitqy waiting 18 hours he met the 11 it-
Egede and signalled that he had a tel
egram for Dr. t ook. The ship stopped;'
and he boarded? For 20 minutes in th?
cabin Mr. Drewson talked to Dr. Cook
anti was convinced of the truth of Dr.
< ook’s story that he had reached Hie
north pole.
“This was my first impression, whi< h
I always consider best,” said Mr.
Drewson, “and 1 was convinced that
the man believed in himself. I sail
to him. ‘Are yon aware that people
will not believe in what you sayi' and]
he replied that he was, and acknowl
, edged that there could be no conclu
sive proofs, such as might not be made
on board ship.”
“Afterwards, however,” said Mr.
Drewson, “I met Dr. Cook many times
and 1 am sony to say that 1 saw the
yellow streak, as you would say. but I
do not believe that Dr. Cook is a fakir.
It is my honest opinion that the man !
is crazy; that be tried to reach the I
pole, and the hardships he endured aud I
the great desire with which he was
possessed unbalanced his mind. I heard '
hiii speech before the geographical so

he had not said me. and I have seen
the paper which ne filed with the Um
versity of Copenhagen. These are like)

much admiration for the Americans and

Cook's manners and his thoroughly de
cent behavior.
“I was present at the dinner which |
was given .by the newspaper men to Dr.]
Cook,” said Mr. Drews*), ‘‘when the
telegram was received that Peary had
discovered the north pole. 1 was mak
ing a speech when the news was receiv '
ed. and when I saw the restiveness in
the gathering I cut short what I had to
say. Immediately the news was brought?
to me ami I was asked to break it to Dr.,
Cook. When I told him that Peary had
telegraphed that he had discovered the
pole. Dr. Cook smiled and said that ifi
Peary said he had done this thing he,
believed him. His whole behavior dur
ing the abuse which Peary heaped upon
him simply charmed and won the highest
admiration of the people of Denmark,
and I don't, think they can be blamed
for their attitude toward him. The'
only blame attaches to the rector of
the university who made him doctor ot
honor before his proofs hail been passed]
upon by the authorities.'
It is the opinion of Mr. Drewsen that
t ook is hiding with the cunning of a
crazy man.
Mr. Drewsen. in company with Theo
dor Low of Austin, nt whose invitation
he is visiting America for the fourth
time, is on his way to Mexico. When
In- was in New York three years ago he
heard much of the cowboy life of the
west, ami it was his intention when he
came o\er to go out on a ranch and live!
this life, but he declares ho finds he was,
misinformed ‘and that the romanticism!
of the old days has passed.
Calls Us Paris of the West.
When he returns to Denmark Mr.
Drewsen says he intends to " rite a book
called “Living Pictures from New
America." which will dispel the idea
that people have abroad that Texas is]
made up of cowboys, six-shooters and
the test of the wild west life, so that
when they come here they will not be
as much surprised as he was to find a
I quiet and fully developed civilized state.

PEACOCK SCHOOL BANQUET
Following a number of interesting
eventr at a track meet preparatory to
taking part in the track meet during
the spring carnival, the pupils of the
Peacock Military school enjoyed their
monthly banquet this afternoon at
12:3(1 o'clock. The guest of honor on
the occasion was Dolly Stark, the popu
lar shortstop of last season's Bronchos,
who has been coaebing the Peacock
school boys in athletics.
Colonel Leßoy Brown acted as toast
master. Ono hundred and fifty pounds
of fish, wlti'h the boys caught in the
lake tills morning, were prepared for
the paiares of the participants in the
banquet.

Judge Dwyer has not yet named tne
grand jury commissioners who will meet
before the end of this week and se
lect the sixteen men from whom a nejr
grand jury will be empanelled. It is
stated that the new grand jury will be
empanelled next Monday morning aud

which are under way by the present
