The attorneys for George Mason, who was recently convicted on a charge of theft from the person aud given a terni of four years in the penitentiary, have filed motion for a new trial. The application was heard this morning before Judge Dillard. The motion for a new trial was based on an affidavit made by Κ. I). Jarrett to the effect that before the trial of tie case was be gun he heard one of the jurors re mark that if Mason got justice he would be sent to the pen for four or five years. Jarrett claims that the remark attributed to the juror was made while the motion for a change of venue was heiiiR heard. The jurors who convicted Mason wpre summoned to appear in court this morning to testify in the proceed ings for a new trial. Ten of* the jurors were present and from this j number Jarrett picked out the man ! ι wh<» "istin!*! did the talhiafr. The ι juror was put ou the stand aud I questioned with reference to the I j matter. He denied ever having ( made the remark attributed to him. ! At ll:;jO the court passed the matter ! over until the other two jurors can [ be secured. The first trial for this week and j probably the last one for thin term of court is now in progress before Judge Dillard. The defendant 111 the case is George Harris, colored, who Is charged by indictment with rape. His alleged victim is a negro ιςίr 1 under fifteen years of aire. The funeral servicea over the body of Que strain, whoio death occurred yesterday morning, were held this mottling at ten o'clock at the resi dence of Mr. J S. Siddoua on Kant Main street. The last sad ritee were conducted by Hev. J. N. Ivy, pa*tor of th»> First Presbyterian church. A large crowd of the de ceased'* relatives and friends were in attendance. Al the conclusion of the services at the residence the Kuighte of Pythias took charge of the exercises. The Knights formed a procession and marched in front of the hearse to the cemetery. At the cemetery the bodv was con signed to its last resting place in accordance with the beautiful burial ritual of the Kuighte of Pythias. The meeting at the Methodist church goes on with greater interest at each succeeding service. Y'ester day and last night several persons accepted Christ and there was re joicing among the Christian people. Rev. Tooiey is doing some stirring goapel peaching and it is having its effect upon the irreligious both in and oat of the church. The pros pect il favorable for a great meet ing. Byron, Texas, April 18—1 will give an outline of my work for three months. In that time I have visited NIX) families, held .S."»0 services, organized three Sunday schools, found 150 families destitute of Bibles and 446 families 6 stitute of all re ligious literature hxcept Bibles. I found 241 families who habitually neglect attending church. Found two large families that dont know.a letter in a book. Some of the fami lies neglecting church and Sunday school have not attended either for thirteen years. Some of them are in our towns and within sight of houses of worship, and members of the church. One family had had membership in a church for twenty eix years and I was the first, preach er to \ isit them. I found two old i women, seventy and seventy one y«ars old and one a hundred years of age ail without God and without j hope in the world. Of course I left feeling thankful that he did not whip me. We need more good men and women in the mission Held. I believe I am on a Bible line. Persecution is a part of our inheritance. Losuskkkk, Observer. I SIMMONS KNOWN HERE The Negro Who Murdered Miss Sdnber< ORce Lived in Ellis County. Henry Simmons, the negro, whc so brutally murdered Miss Lula Sanberg near Manor a few days ago, formerly lived in Ellis county, bringing his family here last fall from South Texas to pick cotton. His wife now resides about two miles from Boyce, and so far as is known she has not been told of the crime with which her husband stands charged and for which he will probably pay the penalty with i his life. I Simmons is not wholly unknown I to the officers of Ellis county. He I had not been in the county long be fore he was wanted in the courte un a charge of aggravated assault. He and his family were picking cotton near Boyce and a complaint was filed against Simmons for slapping a negro girl. Before his arrest could be effected he left the county, but a few days later was arrested in Fort Worth Dy the chief of police. Deputy Sheriff Henry Forbes went to Fort Worth and brought Sim mons to Waxahachie, where he was lodged in the county *jail. Subse quent to his arrest he appeared be fore County Judge Hawkins aud en tered a plea of guilty to the charge against him. A fine was assessed against him and he was sent to the County farm to work it out. Through a mistake Simmons was discharged from the farm before ail of his fine had been worked out Several ef forts have since been made to lo cate Simmons and collect the re mainder of the fine or send him back to the farm. It is known that he spent last Thursday night a wenk ago with his wife near Boyce and it is supposed that he went directly from there to South Texas, where the murder of Miss Sanberg was committed. Simmons' wife is u daughter of Jake Washington, a negro living in the Boyce coummunity. After the murder of Miss Sanberg officers of the sheriff's department expected that Simmons would return to this county and they kept on the look- j out for him until they learned of his i arrest in Austin.
