FATE OF IHE OIL TRUST
Case of Government Against Standard
Oil Company Comes Up Before
Supreme Court Next Week

Washington D C March 12 The
momentous case of the government
against the Standard Oil Trust which
eventually involves the dissolution of
the gigantic corporation is on the eve
of being heard before the court of last
resort the United States supreme
court from the decision of which
there is no appeal The case Living
been advanced upon the docket will
come up for final hearing next Mon
day No case that has been submit
ted to the United States supieme
court in modern times ever attracted
more general interest and lawyers
men of finance politicians men of in
dustry and economists agree in the
opinion that this case together with
the one somewhat similar against the
American Tobacco company present
for the consideration and final deci
sion of the highest tribunal of the
country practically the entire range of
modern industrial organizations and
substantially every feature of the
trust question so far as it falls
within the purview of the Sherman
antitrust law
It is admflted that the Standard Oil
ease is the more important of the
two cases as it affectsthej widest
range of combinations and contracts
which may be claimed to offend
against the Sherman law Under
these circumstances and as this act
in its general scope affects an enor
mous number of business and indus
trial organizations throughput the
country the final decision of the su
preme court is awaited with intense
interest In view of the delicate re
flation which the market Wall
Street and the financial world gen
erally bears to the news and gossip
of the three great branches Of the gov
ernment it will be readily understood
that the decision be what it may is
sure f to produce a profound impres
sion to be fe lt throughout the finan
cial and business channels of the
country
Industrially practically the whole
scope of modern corporate organiza
tion is in one way or another involved
in the case Good trusts and bad
trusts are interested in the outcome
which may affect their very exist
ence If the supreme court should
sustain the judgments of the lower
court it may necessitate industrial
readjustments of farreaching effect
Political leaders realizing that what
ever the final decision may be it will
necessarily affect not only the indus
trial and financial but also the politi
cal situation in this country express
the hope that the court should it de
cide n favor of the government will
at the same time point out some
measure of relief which from any
point of yiew now appears outside the
possible range of legislation
The present case which will come
up in the supreme court next week on
an appeal of the Standard Oil trust
was begun November 15 1900 when
the complaint was filed in the United
Eighth judicial circuit In its petition
ie government complained that the
defendants had conspired to restrain
ithe trade and commerce in petro
leum commonly called crude oil in
refined oil and in the other products
ot petroleum among the several states S
and territories of the United States j
and the District of Columbian and j Cnduct a firstclass blacksmith
with foreign nations and to monopp j shop with all kinds of repairing mod

The bill asset ted that between 1S70
and 1SS2 Henry H Rogers John D
Archbold Oliver H Payne and Chas
M Pratt joined the conspiracy which
culminated with the organization of
vthe Standard Oil companj of New
Jersey in 1S99 It was also charged
that in their alleged efforts to monop
olize the oil business the defendants
had solicited and received rebates on
shipments and later acquired control
of various pipe lines which were
merged into the National Transit com
pany
Service was had upon the defend
ants in December of 100G and the
first legal battle came in the following
month when the defense tried with
out success to have the service le
voked on all concerned save the
WatersPierce Oil company of Mis
souri because it was the only defend
ant resident in the judicial district in
which the suit was filed The con
tention was overruled and the com
panys answer was filed April 9 1907
It Included thirtyseven exceptions to
the governments petition Argu
ment on these took place at St Pauj
May 241907 and the four judges over
rilled every one ot the exceptions
The taking of testimony was intrusted
to Franklin Feci is of Stv Louis who
was appointed special master in chan
cery in June 1907 He fijed his vo
luminous repoit in St Louis on March
22 1909 and the arguments which
lasted a week began in St Louis on
April 5 1909 Then the com t took the
case under advisement and gave its
decision at St Paul in November of
last year deciding against the Stand
ard Oil company and ordering its dis
solution

Away After Lingering Illness

ily home at Tennessee Colony this
county Dr A G DuPuy died after a
lingering illness x
The funeral took place at Tennes
see Colouy this afternoon at 3 oclock
and he was given a Masonic burial
The following gentlemen went via
private conveyances from this city to
attend the funeral

Dr DuPuy was reported dead two
days ago but the report proved un
true He was just hovering between
life and death at the time and the re
port was telephoned toPalestine that
he was dead
Deceased was an old and highly
honored citizen and his death is truly
lamented by all who knew him
Mr J D DuPuy who was constant
ly at his bedside the past few days
was called to his home in thjs city
last night because of the serious ill
ness ot his wife and he did not attend
the funeral

Mr T Fay Cronise whose death
