MESSAGE SENT TO LEGISLATURE
ASKING FOR AMENDMENT TO
STATE LAWS REGULATING THE
SALE OF LIQUOR IN TEXAS
Austin Texas Aug 3 The lire
works broke this afternoon at 330
when the governor submitted the ex
pected message on the liquor ques
tion
The viaduct proposition referred to
in the message is designed to accom
modate Dallas Little interest was
taken in the house in any features of
the message except that portion re
ferring to liquor legislation Mem
bers cheered when the governors rec
ommendation was read especially that
portion referring To such other
matters relating to the regulation of
the liquor traffic as the legislature
may dee m necessary
Immediately after the reading of
the message Nicholls of Hill county
presented bills prepared by Senator
Terrell providing against drinking on
premises where liquor is sold and
prohibiting the sale of liquor within
ten miles of any educational institu
tion supported in whole or in partby
the state which is defined as mean
ing ten miles within any school house
within the state
While wholly expected the action
of the governor has created a sensa
tion and the probable outcome is a
subject of ireat speculation
It is the prevailing opinion that
the legislature will be in session at
least sixty days
The message is brief and reads as
follows
To the legislature By virture of
authority vested in me by section 40
article 3 of the constitution of the
state of Texas I hereby designate and
present to you for your consideration
the following subjects and suggest
legislation thereon
Fjrst Legislation amending chap
ter 16 of the acts of the regular ses
sion of the Thirtyfirst legislature of
the state of Texas approved Febru
ary 20 1909 entitled an act author

having a population in excess of
50000 inhabitants by the last preced
ing United States census to submit to
the qualified voters the propriety of
a bond issue for the construction and
maintenance of causeways viaducts
bridges and approaches across any
rivers within the limits of such coun
ty and to provide for the construc
tion maintenance and use of such
causeways viaducts bridges and ap
proaches and declaring an emer
gency by adding thereto sections
9A and 9B providing a method by
which counties may require land up
on which to construct and maintain
such causeways viaducts bridges and
approaches by condemnation and by

telegraph and telephone corporations
and prescribing the method of such
proceedings

to the nominations of candidates by
political parties so as to provide for
the nomination of candidates for dis
trict and state offices by a majority
of all the votes cast for such offices
and prescribing the duty of the state
and district conventions in such
cases and the method of nominations
in the event of the failure of any can
didate to receive a majority of all
the votes cast for such office and to
provide rules and regulations by
which county candidates may be nom
inated
Third Legislation to amend and
strengthen the statutes regulating
the granting of liquor licenses and
the revocation and cancellation there
of and the regulation of the liquor
traffic and to prohibit the same with
in ten miles of any state education
al institution supported in whole or
in part by appropriations from the
states general revenue and such
other legislation relative to the liquor
traffic as the welfare of the state de
mands and providing appropriate pen
alties for violation of such laws

McMurray Indian contracts met in
the United States court house hereio

The committee consists of Represent
atives Charles H Burke of South
Dakota chairman John H Stephens
of Texas Phililip P Campbell of Kan
sas Clarence B Miller of Minnesota
and Edward W Saundera of Virginia
Senator Gore will probably be the
first witness called to the stand Up
on the nature of his testimony will
depend the list of witnesses to be
summoned by the committee Among
these witnesses will probably be J F
McMurray Royn Hammond of Law
ton Senator Curtis of Kansas former
Senators Thurston of Nebraska and
Long of Kansas Representatives Mc
Guire and Creager of Oklahoma Col
Cecil A Lyon of Texas and various
officials of the Indian Office and of

an attempt at bribery had been made
by J F McMurray an attorney at
McAlester and well known in Wash
ington For many years McMurray
has been connected with the Choctaw

firm came into prominence when their
fee of 750000 for services rendered
the Indian tribes was allowed and
paid
The original contract between Mc
Murray and the Indians was made in
1005 and Col Cecil Lyon the republi
can leader in Texas was said to have
been associated with McMurray and
others in the deal Only recently It
developed it Is said through docu
ments issued from the interior depart
ment that former Senator Long of
Kansas was also associated with Mc
Murray as attorney As a conse
quence of these revelations it is ex
pected that both Col Lyon and for
mer Senator Long will be summoned
to testify before the investigating
committee as to their knowledge of
the Indian land deals j
In some quarters the charge is
made that politics is behind Senator
Gores exposure It is hinted that he
action of Senator Gore in bringing the
charges at this time is really a part
of the Oklahoma democrats program
to defeat the sale of the surface 1 of
the segregated coal and asphalt lands
