president of the United Copper com
pMy and the arch enemy of the amal
gamated Interest*. One of hi* lieu
tenant*. a young man named John
MacOtnnto, wm the owner of a few
•ham of the Boston Md Montana
Copper company. He secured * de
cision from District Judge Clancy ro
etraining the Boston Md Montana
company from paying dividends to the
amalgamated, on the ground that ft Is
contrary to the laws of Montana for
one corporation to own stock In an
other corporation. Furthermore, on
application, he secured a decision
from Judge Clancy in which the latter
raid he might at any time appoint a
receiver for the Boston and Montana.
By these decisions the amalgamated
was badly hampered. Md. the “fair
trial” bill being nullified by the cu
preine court, it could not secure the
transfer of the matter to another
court.
After vainly bringing preaenre to
bear upon the governor to call a spe
cial session of the legislature, the
amalgamated shut down Its mines,
throwing 30 000 men out of work. Gen
eral Manager Scallo* announcing that
under the laws of Montana the com
pany could not secure and
that it would be useless to operate the
mines until assurance of fair treatment
wm given. He also said that the
mines should be reopened whenever
the governor should issue a call for a
•ueclal session of the legislature to
pass remedial legialation. True to
hie promise General Manager Srellon ।
ordered every mine and smelter re-1
opened on the day Governor Toole to
sued bis call for the special cession.

Gates’ Yacht May B* Loot
.Chicago, Dec. I.—A dispatch to the
Tribune from New Orleans, La., saya:
Fears are entertained for the eafety
of the steam yacht Roxana belonging
to John W. Oates of Chicago. It left
here last Tuesday in command of Cap
tain Young of New York, for Port Ar
thur, Texas. Mr. Gates and his party,
consisting of his wife, his son Charles
G. Gates and his wife, Mrs. C. H. Gur
ney of New York, Md two maids, ar
rived with the yacht from Chicago on
November 19. They left for Port Ar
thur yesterday ,ln Mr. Gates private
car intending to' Join the vessel there.
Only the crew was aboard. It is feared
the yacht foundered in recent galee,
and that all were lost.

a dredge wm built two months ago

depth all the way from Corpus Christi

canal and of the simplicity of the feat
of constructing it, together with the
favorable committee assignment ot
Mr. Garner, makes interested parties
feel that there will soon be some
thing doing along the coast.

The Old Jeff Davie Homestead to Be
Used for Indigent Veterane.
Jackson, Miss., Dec. I.—The project
for converting the old Jefferson Davis
homestead at Beauvoir into a home tor
indigent Confederate veterans, which
has been a dream of the United
Daughters of the Confederacy tor a
number of years, today became an
accomplished fact Simple ceremonies
marked thedormal opening today when
nearly two score of indigent veterans
were admitted as inmates, Md Cap
tain James Stone of Greenville, as
sumed charge as superintendent. The
home is to be presented to the state
of Mississippi at the session of the leg
islature next month, and until that
time the expenses of the home will be
borne by private contributions.

of the lowa Retail Implement Dealers’

The suit 1* set aside Md adjudged
void in what to known aa the second
supplementary contract entered into
between the oompaalea In 1897, which
amended the lease of the Harlem to
the New York Central company. This
contract reduced the rent payable
by the Central compMy to the Har
lem company 3220.000 a year for the
unexpired term of the lease after May
1, 1900, making the total reduction
mentioned.
In addition to this, the plaintiffs al
lege certain Irregularities in connec
tion with the refunding by the Central
of 810,000,000 of Harlem company's
bonds, whereby syndicates made up
of favored director* Md stockholders
in both railroad companl** made enor
mous profits that should have gone to
the New York and Harlem stockhold
era.
Referee Andrew* will conduct a fur
ther hearing tomorrow when it is ex
pected that the testimony for the com
plainants will be concluded.
