"P ion that the firgt Governor'* me, d nage to the first Legislature of the new State of Idaho, is a straight forward lmsiness document, setting forth in plain and dignified lan guage the condition of the Stale and making such recoininondation* as to the Governor «ceins best for the well lieing of the people of Idaho. He tell* us that the prink'd copies of the Constitution show several va riations from the original one on file in the office of the Secretary of the Territory, and recommends that the papers be placed in the hands of a commission and carefully tran acrilied under their direction. This is certainly an important recom mendation and should lie done a* ' of, and first day its the of or to soon aa pomiblc for the guidance of the present legislature if there is any probability of lieing auch a va riance aa would endanger a conflict with the orgnnic act in uny législa tion that might he enocted. The Governor says lie can not ad vise any modification of the existing Jaws in relation to suffrage. It is not at all liktdy that he will he asked to do so by any one. The finances of the State appear to be in a very satisfackiry condition. He recommends that the $27,116.68 in the Capital building fund lie in vented in State warrants, where it tyfil he drawing interest, or rather saving it, which seems to he a very sensible view of the subject. The Governor alludes to the large amount of State lands and reminds the legislature that its disposition lies with them and there is danger of losing a part of it unless prompt nction be taken on the part of the land commissioners. Water rights, the Columbian ex position, Board of Tardons, the Ten itentiary, public schools, University of Idalio, State wagon road, agri cultural college, live stock, public health, care of the blind, deaf mute and the insane asylum are all treated upon in a manner witli which no fault can tie found. Among the many recommenda tions classed under the head of mis cellaneous, the Governor recom mends the appointment of a Board pf Code Commissioners to revise the statutes after the legislature shall have completed its session. This would seem to lie an imperative necessity, as the Governor says it would savo the people many times its cost in legislation. It is quite certain that the statutes will lx? in such a fix after the legislature shall have completed its labors that it will be difficult to find out wlmt the law really is in relation to many things. In a supplemental message Gov ernor Slump does ample justice to the vast mineral resources of Idaho. If the owner or claimant of any stray animal ixt unknown, the laker-up must, within ten days after taking up such animal, |ai#t written notices giving a description of such animal, the marks, brands, natural or artificial, ns near as practicable, the name and residence of the laker-up, one in three public places of the countv und one also shall lie posted at the door of the Auditor of the said county, or give such notice by publication thereof in a weekly new«pa|x-r pub lished in the county, in at k-osl four issues of said paper; the written no tice must also tie deposited by the taker up of such estray in the office of the County Auditor, and must he kept on file by said Auditor fur the period of six months. Hec. 1363, If the owner, or any per son entitled to the |io*«es8ion of an estray, ap|>ear at any time within two months after said notice is hied witli the Auditor, aa aforesaid, he is entitled to tlie (Missession of such estray upon payment of all lawful chaiges which have been Incurred in relation to the same ; provided, that ho need not pay for the keeping of said estray more Ilian live days prior to the tiling of the notice with the Auditoi by the taker-up. Hec. 1364. If any |x-rson entitled k> ixxisession of any estray dix>s not ap peur and substantiate his title thereto, and pay the churges thereon, within two mouths from the time when such notice is tiled with the Couuty Au ditor, such estray must lie sold at the request of the taker-up by the Sheriff or uny Constable of the county, at public auction, upon first giving public notice thereof, in writing, by |xjsting up the same in three of the most pub lie places in the precinct where such estray was taken up, at least ten duys before such sale, and the tukcr-u|> may kid thereon at such sale ; and after deducting all the lawful charges of the taker-up, ns aforesaid, and the fees of the sheriff or constable, which are the same as on an execution, the re maining proceeds of such sale must Ik- deposited in the comity treasury. Hcc. 1566. If uny person, without the consent of the taker-up, takes away any stray taken up pursuant to the provisions of this title, without first paying all the lawful charges incurred in relation to the same, lie is liable to the laker-up for the full value of such stray, and may In; proceeded against before any court liaviug competent ju risdiction.
