assigns, the right to construct, maintain and
operate, in the city of Orangeville, Idaho, and
under streets and thoroughfares thereof,
poles, wires aud other appliances and con
ductors for the trausmission of electricity for
telephone purposes.
Be it ordained by the mayor aud council of the
city of Graugeville:
Hection l. That a right and privilege is here
by grau ted The NesperceCo operative Telephone
Company, its associates mud assigns, to ereet, or
lay, maintain and operate iu the city of Grange
ville, Idaho, inWuaiug all necessary streets,
thoroughfares thereof, poles, wfres
and other appliances and conductors for the
trausmissiou of electricity for telephone pur
poses. Huch wires or conductors may lie struug
upoii poles or other fixtures above grouud or
laid under the ground iu pipes or conduits or
otherwise protected aud such other apparatuses
iv be used as necessary or proper to operate
d maintain the same.
Section 2. It shall be lawful for the said The
Nezperce Co-operative Telephone Company, its
associates and assigns, to make all needful ex
cavations iu the city of Orangeville, Idaho, for
ï he purpose of erectiug aud maintaining poles
or other support for said wire or for tbs purpose
of layiug down, maintaining and operating
other conductors uuder ground for the purpose
aforesaid.
Section 3. Whenever Hie said The Nezperce
Co-operative Telephone Company, its associates
and assigns, shall disturb any of such streets
thoroughfares for the purpose aforesaid, it or
they shall restore the same to good order aud
condition as soon as practicable and without
unnecessary delay; aud failiug
city of Graugeville, Idaho, shall have the right
to fix a reasonable time iu which such repair
and restoration of streets shall be completed,
aud iu the event any damage results from any
negligence upon the part of BAid company in
properly protecting and guarding against
acciaeuts, or from the erection and mainten

claim that shall or may be recovered of or from
said city, from or 011 account of the erection,
maintenance and conducting of any such poles,
wires, conductors or other appliances, shall be
a lieu upou and against all the property, appli
ances and apparatus of the said The Nezperce
Co-operative Telephone Compauy, its succes
sors and assigns, within the said city of Grange
ville, Idaho, and such lien shall aud may be
enforced iu any court of competent Jurisdiction,
and any decree or judgment rendered thereon
shall include, in addition to the costs provided
by statut«, a reasonable sum to be by the court
allowed for the foreclosure of such lien.
Section 4. The places where the poles are set
or maintained shall be such as to do os little
damage to or obstructiou of streets and thor
oughfares os possible; aud such places shall be
designated and determined by the street com
mittee of said city, and no poles shall be set or
maintained at any other place than as desig
nated and determined by said committee. AU
wires shall be supported by safe and substantial
means.
Hectiou 5. Should The Nezperce Co-operative
Telephone Company, its successors or assigns,
at any time during the life of this franchise sell,
dispose of, lease or consolidate with any other
compauy or association doing a telephone busi
ness in said city of Grangeville, then and iu
that event, this franchise shall at once cease
and determine, and all rights aud privileges
herein and hereby granted shall become al au
end. The lntentlou being aud it being hereby
provided that the said
time sell, lease or consolidate with any other
company or association doing a telcphouo busi
ness in s&id city at the time of such sale, lease
consolidation.
section 6 Nothing in this ordinance shall be
construed in eny way to prevent the proper
authorities of the city of Graugeville, Idaho,
from sewering, grading, planking, repairing
altering anv of the streets therein mentioned,
but all such work shall be done if possible so as
not to obstruct or iniure the free use of said
poles, conductors, couduits, pipes
apparatuses.
Section 7. The seid The Nezperce Co-opera
tive Telephone Compauy, its associates or
signs, shall have the sain telephone line
pitted to the said eity of Graugeville, Idaho,
and have the same in operation within six
mouths from and after the passage and approv
al of this ordinance and franchise. In event
said line be not completed to said city
Graugeville, Idaho, and be in operation within
■aid six mouths, then all rights and privileges
uuder this ordinauce and franchise shall at
once cease and determine, and this ordinance
•hall in case of such failure as aforesaid, be
void and of
Hectiou 8. The rights, privileges, and fran
chises herein granted shall continue and be in
force for the period of twenty five years from
and after tbe passage and approval of this
ordinance, unie«« sooner terminated by a fail
ure to complete said line within the time as
above specified, or upou the Judgment of any
court of competent jurisdiction Tor a substan
tial failure upon the part of said company to
keep xuy of the requirements os herein ex
pressed and contained.
Section 9. This ordinance shall be in force
and effect from and after its passage, approval
and publication.
