The above matter coming on regul arly to be heard and the fallowing persons having paid taxes for the year 1909 and requested a refund of same; the Board not being advised* that there was no authority of law for such refund it is therefor-; order ed that the applications be denied. On this day come on for hearing the petition in the above entitl'd matter, said petition being accompan ied by a sufficient bond as required by law, and it appearing that due and legal notice has been given by posting and publishing as is requir ed by law and it further appearing to the Board that Ithe appointing of viewers ini this matter is unneces sary and that the proposed change of the road will not be materially in creased, to the injury of the public, and the Board having received sat isfactory evidence that the proposed mew road has been opened a legal width and in all r- spects made equal to (the old road for the convenience of travelers; it is therefore ordered that such new road be and the same is hereby declared a public highway and that so much of the old road as is embraced in the new is her by va cated. The description of the said new read is as follows: Beginning on the north line of Section One in Township four south of range thirty three E. B. M. and running diagon ally through said section in a general southwest- rly direction to the west line of said section be abandoned and that the new road be establish ed on the section line on the north and west of said section intersect ing with the old read. In the matter of Mary E. Broadhead, indigent. The above matter came on for h ar ing at this time and the Board re ceiving satisfactory evidence that the said Mary E. Broadhead* required as sistance from the County it is there fore ordered that the clerk of said Beard be authorized to permit the purchase of the necessary articles for th* said Mary E. Broadhead in sum not exceeding $10.00 per month for such time as the said Mary E. Broadhead may require such as sistance. In the matter of road petition of Albert Hjlm et al. The above matter was referred to Commissioner Bennett for furth r in vestigation. In the matter of appointing constable for Taylor precinct. Christian Andersen of the above precinct appeared before th< Board and requested the appointment of a constable for the above named pre cinct and recommended the came of Amos Hark r for such pcsition, ., hereby ordered that the said Amos Harker be and he is hereby appointed constable for Taylor precinct. In the matter of the creation of a new road district in Aberdeen. The above matter came regularly on to be heard and the sam . was re ferred to Commissioner Jones. In the Matter of the Herd Petition of Aberdeen Commercial Club. The above matter coming on for hearing at this tim- and it appearing to the Board that Ithe above petition had not been regularly presented it is therefore ordered that the ab:*ve matter be and the some is hereby set for hearing at a special meeting cf this Board to b held ctni the 12th day *of May, 1911, ait the hour of 11:00 o'clock a. m. In the matter of obstructions in the public highway at Monroe Station. The above matter being presented Ito the Beard at this time and shown that by reason of loading b ets at the beet dump at the said station the soil from loading said beets had be come an obstruction in the public highway. It was ordered that Ithe County Attorney be instructed to no tify the manager of the Utah-Idaho Sugar coompany at Idaho Falls, to imm diately cause toi be removed such obstruction. The above matter coming on this day for hearing, the directors of said Fair Association appeared before the Board and* requested an appropriation of $1800.00. The matter being fully discussed and it appearing ito the sat isfaction of the Board that the South eastern Idaho Fair Association is a legally organized agricultural fair as sociation having for its object the ex hibiting of live stock and agricultur al products of Southeastern Idaho, it is ordered that the sum of $1500.00 be and the same Is hereby directed appropriated to be paid to the direc tors of said association Ito assist in the defraying of the expens s of pre miums to be awarded at the Fair to be held for the year 1911, in accord ance with the provisions *cf Section 3040 Revised Statutes cf Idaho. In the matter of the official bond of F. E. DeKay. F. E. DeKay, sheriff of Bingham coumty, having this day filed a sure ty bond executed by the Union Cen tral Fidelity and Guaranty Co., in the sum of $10,000.00, the same was ap proved and ordered substituted in lieu of a personal bond In like amount executed by C. W. Berryman and Geo. F. Gagon and that the said C. W. Berryman and Geo. F. Gagon be and they are her by released frc*m all further liability os said 1 bondsmen. In the matter of surety bond of First National Bank. The First National Bank of Black foot, having this day filed a surety bond cf the American Surety Com pany of New York in the sum of $5,049.00 as custodians of the county funds, the same was approved. Stufflebeam and seconded oy T. R. Jones that th Clerk cf the Board be and he is hereby appointed as the purchasing officer of this county to purchase all supplies of whatever na ture, for the different offices and of ficers of Bingham County. It was further ordered that the mutter pertaining to* advertising in the newspapers of this County for andi in behalf of Bingham County re ferred to the Clerk of this Board. In the matter of incurring indebted ness against Bingham County. The above matter being fully discus sed at this time it wus ordered that th policy of Bingham County here after shall be that no indebtedness shall be incurred against saidi county without the same being first duly thcrized by one *cr all, of the commis sioners or the clerk of said* county, or by such person as either of these may authorize to incur such indebted ness as abcive stated. In the matter of making public the above resolution. The Clerk of the Board* of County Commissioners is hereby authorized and instructed to have printed let ters containing the informait ion em bodied in the above mentioned reso lution and mail a copy of each to all of th officers of the said Bingham Courait y , and that he shall also, have the same published in the Shelley Pio neer of Sbelley, Idaho, the Aberdeen Times of Aberdeen, Idaho, the Idaho Républicain of Blackfoot and the Blackfoct Optimist of Blackfoot, Ida ho. Claims against the Count. y were at this time allowed on the current ex pense fund' amounting in all to the sum of $13,416.94, said claims being numbered from 1 toi 256 and the amounts being set out in the proper columns of the allowance book at pages 58 to 61 and the clerk is here by directed to draw warrants for the amounts of such allowances. Claims against, the county were at this time allowed on the road fund amounting in all to th- sum of $3,248.41, said claims being number ed from 1 to 158 and the amounts being set in* the proper columns of the .allowance book at pages 115 to' 117 a*nd the Clerk is hereby directed: to draw warrants fc*r the amount of such allowance. Claims against the County were at this time allowed on the Bridge fund amounting In all to the sum of $16, 263.38, saidi claims being numbered from 1 to 107 and the amounts being set cut in the proper columns of the allowance book at pages 178 to 179 and the Clerk is hereby directed to draw warrants for the amounts of such allowance.
