The City Council of the City of Twin Falls met in adjourned regular session at the regular meeting place of said board to-wit: in the Commer cial Club rooms in the Boyd Block on Main Avenue in the said City of Twin Falls, on Monday, the 27th day of December, A. D. 1915, at the hour of Eight O'clock P. M, The meeting was called to order by the Mayor, and, upon roll-call, the following members and officials were found to be present: E. M. Sweeley, Mayor: -'Councilman: C. M. Smith. P'. F. Bracken, R. E. Bobier, R. A. Parrott, R. M. Williams, City Clerk. Constituting the entire City Council. Also present: George Harriott, City Attorney. H. E. Rounds, City Treasurer, W. F. Porter, Street Commissioner J. M. Chambers, Plumbing Inspec tor. The following, among other proceed ings were duly had and taken, pursu ant to law. Thereupon Councilman Smith mov ed ; that "All proceedings of a regular meeting of the Council, held on No vember 15, 1915, and all previous affirmative action had and taken by the City Council, relative to the proposition of issuing bonds for the acquisition of a waterworks system tor the City of Twin Falls be ex pressly confirmed and ratified;" seconded by Councilman Bracken. The Mayor put said motion to the Council, and vote upon said motion re sulted as follows; Councilman Smith, Aye Bracken, Aye, " Bobier, Aye, Parrott, Aye. The Mayor thereupon declared said motion unanimously carried and duly passed, adopted and approved and or dered the proceedings of the regular meeting of November 15th to be prop erly published together with the pub lication of the proceedings of this meeting. Councilman Bobier introduced and moved the adoption of the following ordinance, which ordinance was read in full by the Clerk. "ORDINANCE NO. 171. AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF TWIN FALLS, IDAHO, AT A SPECIAL ELECTION TO BE HELD ON THE 3rd DAY OF FEB RUARY, A. D. 1916, THE QUESTION OF AUTHORIZING THE CITY COUNCIL OF SAID CITY TO ISSUE $80,000. IN BONDS OF SAID CITY, OPTIONAL AFTER 10 YEARS AND DUE 20 YEARS FROM DATE, TO BEAR A RATE OF INTEREST NOT EXCEEDING 6 PER CENT, FOR THE PURPOSE OF ACQUIRING BY PURCHASE THE EXISTING WA TER SYSTEM OPERATING IN SAID CITY. TO BE OWNED AND OPERATED BY SAID CITY AND TO PROVIDE FOR THE PAYMENT OF THE INTEREST AND PRINCI PLE THEREOF BY LEVY OF THE NECESSARY TAX THEREFOR. WHEREAS, In the opinion of the City Council of the City of Twin Falls it is necessary, in order to furnish to its citizens necessary protection from fire and for the furnishing of water for domestic and commercial purposes, that the City should own its system of water works, and that it is for the best Interest of said City, that the same should be owned and operated by said City, and that the question of the ac quisition of said water works system and the issuance of bonds therefor, should be submitted to the qualified electors of the City of Twin Fails; and, WHEREAS, the City Council does deem it advisable at this time and as approximate to this time as may be possible, to have the qualified voters and electors of the City of Twin Falls determine by election whether such a waterworks system should be acquir ed by said City, by authorizing the is suance of $80,000. in bonds, to defray the expense of purchasing and ac quiring the complete water w'orks sys tem aforesaid for said City, according to the provisions of a resolution of the City Council of said City, passed on the 4th day of October, A. D. 1915, and approved by the Mayor on the 6th day of October, A. D. 1915, and published in the official paper of said City on the 26th day of October, A. D. 1915, which said resolution and offer to purchase was duly accepted on the 9th day of October, A. D. 1915, by the present owners of said water works system, the Twin Falls Waterworks Company, Limited, a corporation or ganized and existing under the laws of the State of Utah and authorized to do business within the State of Ida NOW, THEREFORE, BE IT OR DAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF TWIN FALLS, IN TWIN FALLS COUNTY, STATE OF IDAHO: SECTION 1. That a special election of the voters of the City of Twin Falls, Idaho, for the purposes above set forth, is hereby called for Thurs day, the 3rd day of February, A. D. 1916. SECTION II. That at said election, the voters qualified to vote on the said proposition, shall be; those duly qual ified electors of said City who are taxpayers under the law and who have paid a property tax in said City in the year next preceding said election; said election shall be held on the 3rd day of February, A. D. 1916, at which election, there shall be submitted to said qualified voters, the question of acquiring the existing water works system within the City of Twin Falls, for said City of Twin Palls, including all existing and incidental rig.its, franchises, property and interests therefor, for the purpose of supplying said town of Twin Falla and its in habitants water, for fire, domestic and commercial purposes and to provide for the payment therefor by the is suance and sale of bonds of said City, in the aggregate amount of eighty thousand dollars ($80,000.), to be hereafter Issued pursuant to ordinance to be hereafter passed by the City Coun ho. ell of said City of Twin Palls, In man ner, form.and terms as by law required; said bonds to mature twenty years and and become optional ten (10) years from issuance, to bear interest at not to exceed six per cent per annum. The City Council of said City of Twin Falls shall provide by ordinance for the levy of tax to redeem said bonds and to pay the interest thereon as pro vided by law; provided that no action or proceeding by the City of Twin Falls shall prevent the application of any or all of the net surplus earnings of said water works system to the payment of said principal or interest when such application of said earn ings seems advisable. SECTION III. The question so sub mitted shall be voted on at said elec tion, which shall be held at: What is commonly known as Crosby's chapel in the new building at number 123 Second Avenue West in the said City of Twin Falls, for Ward No. 1 of said City, and in the Warberg building at 211 Shoshone Street South in the said City of Twin Falls for Ward No. 2 of said City, by the qualified voters ot said City aforesaid, and shall be by ballot in the form hereinafter des cribed, and said election shall be held and conducted in as near the same manner as that prespribed for general and special municipal and state elec lions as may be possible. SECTION IV. Separate printed oal lots shall be procured by the City Clerk and supplied to the election judges to be furnished to the quali fled electors, and ballots shall be printed according to the following form, to-wlt; "OFFICIAL BALLOT CITY OF TWIN FALLS, IDAHO. ELECTION UPON THE QUES TION OF PURCHASING WATER WORKS SYSTEM AND THE AU THORIZATION OF THE ISSUANCE OF $80,000, IN BONDS FOR SAME. TWIN FALLS, IDAHO, FEBRUARY 3rd, A. D. 1916. QUESTION; Shall the City Council of the City of Twin Falls be author ized to issue bonds of said City in the amount of ($80,000.) to become due 20 years from date, optional for redemption 10 years from date, and to bear a rate of interest not to exceed six per cent. (6 per cent.) per annum, for the purpose of raising funds for the acquisition by purchase of the existing waterworks system within and near said City, to supply said City with water tor fire, domestic and commercial purposes, said system to be owned, maintained and operated by said City. I IMPORTANT INSTRUCTIONS The voter will place an (X) in the space opposite and to the right of the answer to the question above sub mitted, which indicates his choice. Said ballot shall be cast by each voter marking said ballot by placing an (X) in the square opposite his choice, in the same manner now pro vided for voting by the municipal and general election laws of the State. No ballot for or against the question submitted shall be received from any person who is not a qualified elector of the City of Twin Falls and a taxpayer in said City of Twin Palls, under the law and defined by statute, shall be canvassed as in the manner SECTION V. Said vote prescribed for general and municipal elections, in so far as applicable. SECTION VI. The following named persons, qualified electors of the said City of Twin Falls, are hereby ap pointed judges and clerks of said elec tion. Ward No 1: Judges: Fred Wilkerson, Geo. Taber, D. A. Seaman. Clerks: T. M. Robertson, R. C. Letsch. Ward No. 2: Judges: P. E. Dean, S. B. Camp, I. H. Brashears. Clerks; Friedolph Olson, C. H. Stin son. SECTION VII. It shall be the duty of the City Clerk to arrange for and supervise the details of said elections, not otherwise provided for herein, and to provide for the proper registration of electors and the certification of taxpaying voters for use at said elec tion, in the manner now provided by law governing the holding of general municipal or state elections; and the City Clerk and the election officials herein designated are hereby author ized to procure from the County Clerk of Twin Falls County, any books, lists, forms, data, information, etc., as may be needed in order to properly con duct the election herein called. SECTION VIII. The vote cast at said election shall be canvassed and return made in the same manner or as nearly the same as may be possible, as provided by law for the canvass ing and return of votes cast at elec lions of municipal officers and the State laws governing State and Coun ty elections. SECTION IX. The City Clerk is hereby directed to cause to be publish ed at least weekly a notice of said election after the conclusive passage and adoption of this ordinance, begin ning said publication at least thirty days before said election is to be held in "The Twin Falls Times," a newspaper of general circulation with in said City of Twin Palls in Twin Falls County, State of Idaho, and also cause to be posted a copy of said no tlce at the place of holding said elec tion in each ward and also at three public places within said City at least thirty days before said election is to be held, and it is hereby made the duty of the Clerk of said City to issue and cause said notices to be published and posted, as required by law. Said notice shall be substan tially in the following form, to-wlt: "PUBLIC NOTICE, CITY OF TWIN FALLS, WATERWORKS BOND ELECTION FEBRUARY 3rd, A. D. 1916. NOTICE IS HEREBY GIVEN that pursuant to a certain ordinance duly passed and approved pursuant to law by the City Council of the City of Twin Falls, on the 27th day of Decem ber, A. D. 1916, and numbered 171. Public notice is hereby given that a special election is hereby called in the City of Twin Falls, to be held at what is commonly known as Crosby's chapel in the new building at Number 123 Second Avenue West in the said city of Twin Falls for Ward No. 1, 0 f said City, and in the Warberg Build i ng a t 211 Shoshone Street South in the said City of Twin Falls for Ward No. 2, of said City, on the 3rd day of February, A. At said election no elector of the City of Twin Falls will be allowed to vote unless he or she snail be a tax payer, under the laws of the State of Idaho, The term ''Taxpayer'', under the law, means and includes those per sons only who are qualified electors under the registration and election laws of the State of Idaho and who in the calendar year last preceding the said election paid a tax or were liable to pay a tax upon real or personl pro perty within the corporate lim its of the City of Twin Falls, which has been assessed to them and belongs to them in said City. The ques tion being upon the adoption of said motion and the suspension of the rules, the roll was called with the following results: City Clerk. All members of the City Council hav ing voted in favor of said motion, the Mayor declared said motion duly car ried, and the rules suspended. After thorough consideration, Uie Council, with unanimous consent of all members, made the following de terminations ; That the election should be held on Thursday, the 3rd day of February, A. D. 1916, and be governed as to poll ing places and officials as follows: Ward No. 1. polling place at what is commonly known as Crosby's cha pel in the new building at Number 123 Second Avenue West in the said City of Twin Falls. Stln son. Councilman Bracken moved that the foregoing ordinance, entitled. BE HELD ON FEBRUARY, The Mayer thereupon all the Councilmen having voted in favor thereof, the said motion was car ried, and the said ordinance was duly passed and adopted by the City Coun cil, and he forthwith proceeded to ap prove same by signing, which was at tested and sealed by the Clerk. On motion duly adopted, the Mayor ordered that said ordinance be num bered "Number 171 and be published in 'The Twin Falls Times,' the official newspaper of the City, and be recorded according to law in "the Ordinance Book" and records of the City.
