Upon motion of I. M. Under wood , Prosecuting Attorney of Tyler county, James H. Strickling was appointed his assistant. In the matter of the Parkers burg and Ohio Valley Electric Railway company against B. C. Lock wood, Grace Lock wood, Ed mond Lock wood, upon an appli cation to condemn lands, the court nominated the following disinterested parties for the pur pose: Joseph McKay, James M. Peoples, A. II. McGinnis, J. L. Mc Intvre, David Pounds, Frank L. Illaught, Robert McCormick, Geo. B. Stocking, Nathan Salisberry, John \V. Smith and Andy Bru ner. Out of the thirteen nomina tions five commissioners were se lected as follows: Joseph McKay, Robert McCormick, G. B. Stock ing, Nathan Salisberry and John W. Smith. Cases of the State against the following parties were continued: John Smith, H. D. Appleby and H. E. Wilson. State vs. A. J. Wilson, confes sion and fine of $1 and costs. State vs. Clara Edgell, contin ued and defendant gave bond in the penalty of $100 with J. R. Cherry as surety. Appointment of E. B. Long, Thomas Doak and W. T. Conner as trustees of Mt. Franklin VanCamp, charged with the murder of Peter B. Low ry, appeared in court and entered a plea of not guilty. Upon mo tion to be admitted to bail, Judge Willis fixed his bond at the same amount as before, $3,000, return able on the first day of the Au gust term of court. W. E. Van Camp is surety on the bond. THREE THOUSAND DOLLARS DAMAGE The civil case of the Fisher Oil company against Steelsmith & Yoke was tried in the Circuit court this term, and the jury af ter being out less than half an hour returned a verdict for Fish er Brothers for $3,000 damages. Some time since Steelsmith & Yoke drilled in a large well in the Elk Fork, and Fisher's owned a lease that went up close to the well. They started to drill on their lease when Steelsmith & Yoke stopped them from drilling the well by an injunction. After a long time the injunction ? was dissolved and Fisher:#^ sued for damages for being delayed in drilling the well, for in the mean time Steelsmith & Yoke were op erating their well and getting the oil from Fisher's lease. It proves after all that injunction was quite an expensive luxury. . Snow, freezing, baseball post ponements. circus agents, etc., all in two days. If there is not to be any spring weather this month of April we are having strenuous times, and a little excitement is sometimes good for everybody. t * : We had snow and rain today. Mayor Lynn ' Kirtland presided, and all councilmen were present with the exception of S. W. Templeton, of the Second ward. But little busi ness was disposed of, aside from allowing a number of bills. The garbage question was discussed to some length, and finally the matter was turned over to the ' Health committee. The disposi-j tion of garbage is a question of great importance to all citizens, and the committee in charge have been instructed by the council to dispose of it in a way that will give entire satisfaction to all res idents. A derrick of the Carter Oil company, located on a lot of G. W. Stocking, on Virginia street, was deemed unsafe, and or dered repaired at once. The Mountain State Gas company gave notice to council that after May 1 all gas lights in the city would be increased in rates from $1 per month to $4. No action was taken in the matter, but it is quite probable the lights will be discontinued. Council adjourned until next Monday night, at^ which time license to the several saloons will be granted, t _______ Company A Inspected. Company A was briefly inspect ed last evening by a special offi cer from the United States army. The officer did not arrive in. the city until 10:40, and consequently he did not have time to make a thorough inspection. However, he expressed himself as being well pleased with the progress the company is making. Notwith standing the lateness of the hour the attendance was large last night, which is ample evidence the members are all taking great interest in the new organization. Col. Morrison, of Parkersburg, was present. Circuit court is still grinding | away, but in all probability it will adjourn the latter part of the month. Don't Worry AM lour Sonday Dinner!
