Against Execu tive Orders The Supreme court lias had un der consideration a case relating to second-class mail matter. The question involved was whether or 1 not * certain matter should be j classed as second-class. It was admitted before the Court that ' it had been so classed for sixteen ; years, although the Postoffice de partment had endeavored repeat i edly to secure legislation from j Congress that should place the matter in another class. Failing .to secure legislation the Post ' master General had issued an ar I bitrary order classifying the mat ter in accordance with his appeals to Congress. From this order an appeal to the courts was taken. The Court handed down a major ity and minority opinion. The minority opinion is of more in terest, as it goes beyond the mere question of classification. It is written by Justice Harlan, who takes the ground that the order of the Postmaster General "is a mode of amending and making laws which ought not to be en couraged or approved." This is what Justice Harlan said: It was admitted at the bar that for more than sixteen years prior to May 5, 1902, the Postoffice had acted upon the identical con struction of the statute for which the appellants contend. During that period many different post masters general asked Congress to amend the statute so as to exclude from the niails, as second-class matter, such publications as those issued by the appellant, and which, under the present ruling of the department, are declared not to belong to that class of mailable matter. Again and again Congress refused to so amend the statute, although earnestly urged by the department to do so. Thus, by a mere order of the department that has been accom plished otherwise than by change in the language of the statute itself, which change, as we have said, Congress deliberately refus ed to make after hearing all par ties concerned and after extended debate in each house. * * * This is a mode of amending, and making laws which ought not to be encouraged or approved. Between the Postmaster Gener al's order in this case and the President's recent pension order there is a great similarity. The Postmaster General carried into effect by a simple order the very provisions which he had asked Congress to legislate. The Presi dent by his order granted ser vice pensions, in many cases, to veterans whose claims thereto were being considered by Con gress for the purpose of legisla tion. If now the Postmaster Gen eral's order "is a mode of amend ing and making laws which ought not to be encouraged or approv ed," it certainly must follow that the President's pension order is also "a mode of amending and making laws which ought not to be encouraged or approved."
