[Continued from Page 2.] quainted with the applicant, that they have good reason to believe that each and all of the state ments contained in the petition are true, and stating their names in full, and their placcs of resi dence and the kind of business in which they are engaged. i If the business is to be carried on in an incorporated city, town 'or village the municipal authori ties whereof are not vested with the sole power to grant licenses, the applicant shall pi ocur e from ! the clerk of such city, town 01 ?village a certified copy of the or der or resolution of the Council of said city, town or village au thorizing or assenting to such li cense, and shall file such certi fied copy with his said petition. Section 1. The court shall hear the petitions at a regular or spe cial term called for that purpose on the first Monday of April of each year, in the order in which they are filed with the clerk, who shall prepare a docket thereof, and the court shall grant or re fuse the licenses applied for. The said County court shall hear any petitions of residents of the coun ty. in addition to that of the ap j plicant, in favor of, and any re I monstrance against the applica tion for such license, and in all leases shall refuse the same when ever in the opinion of said court (having due regard to the num ber and character of the petition ers for and against said applica tion) such license is not neces sary, or that the applicant is not a fit person to whom such licenso should be granted. Upon suffi cient cause being shown, or proof being made to said court, that the person holding the license has knowingly violated any law of the State, relating to the sale of li quors, the said court, upon notice being given to the person licensed shall revoke the said license. Section 14. If the license de sired is for any of the purposes i named in paragraphs b, c and e of said first section and the busi ness is to be carried on in an in corporated city, town or village, the municipal authorities where of are vested with the sole power of granting such license, the Council shall constitute a license court for such municipality, of which the Mayor shall be presi dent and the clerk of the munic ipality shall be clerk of said court, in each case without any addition al compensation. The court so constituted shall hear and deter mine petitions for such license and remonstrances of residents* against the same, which shall in all things conform to the require ments of the petitions of .vppli- 1 cants and remonstrances of resi dents in county courts; and the said clerk shall perform all duties as to publication and otherwise required of clerks of county courts. , Such license court shall be gov erned and controlled in the hear ing and granting or refusing such license in all respects as pre-j scribed herein for granting or re-1 fusing such license by the County j courts. Said license court shall convene for hearing such peti tions at the same time provided ; herein for County courts and shall ! sit from day to day until the bus- j iness is completed. Section 16. When the county or license court shall have grant ed a license for any of the pur poses mentioned in paragraphs b. c and e or of said first section I as provided herein the clerk of j the County court shall issue a j certificate of license in the form to be prescribed by the State Tax commissioner, etc. Such certifi cate shall be turned over by the clerk to the officer to whom the State tax is to be paid as pre scribed in the case of certificates in other cases, and his receipt foi such tax. written on the certifi cate. shall, with the certificate, constitute a license, while it re I mains in force, to the person and | for the purpose specified in the , certificate, except so far as other wise proided in this chapter. The above is a synopsis of the i law as it now exists, and I believe the proper construction of it is that all applications for the sale of intoxicating liquors should be filel with the proper authorities at such time before the first Mon day in April of each year so that the publication of the intention of the applicant may be publish ed at least twenty-two nor more than thirty days prior to that time. And after that time has , elapsed no application can w r*l ceived by the authorities until the following year. In other words, all those who have failed to make proper aplication for a license to sell spirituous liquors in this State for the license year begin ning May 1, 1905, are estopped from securing such license until ' 1906. , . . As will be seen from clause foui of section 12, no person or cor poration can hereafter secure li cense for more than one saloon in a county, except that any per son, firm or corporation may se cure a license to sell liquors at wholesale and retail providing that the application is made for lone and the same place, and ex cept further, that the application be a distiller or brewer, he has applied or intends to apply for a wholesale dealers' license m the i county. In the country districts land in towns and villages where | a special charter has not been iirranlid such towns and villages I by the Legislature giving them ? the right and authority to grant 1 licenses through the Council or Excise board, all appl:cations should be made to the County court and filed with the clerk of said court in the proper time. In I the cities find towns where, through a special act of the Leg islature, authority has been given the Council* to grant or refuse licenses in conjunction with the County court applications should be filed with the clerk of the County court as well as the de^ posit of $10 made with said clerk and a copy of said petition filed with the clerk or recorder of said city or town and a permit be granted bv the Council to apply to said County court for such li cense. The County clerk being the proper officer to publish, etc. j In cities, such as S'stersville, Parkersburg and others, where by the provisions t?f the city au thority exclusive authority to grant or refuse license to sell spir ituous liquors, wine, beer, etc., has been given the City Council (as is mentioned ' and contained in sectio.i 28 of the Parkersburg | charter, passed by the Legisla I ture of 1903) all applications j should be filed with the clerk or j auditor, as well as the sum of I money to defray the expenses of j publication. Therefore, it will be I seen that the Mayor and City I Council of such cities compose the i license board and have sole con trol of the matter, and the County court has nothing whatever to do with the granting >T licenses in such cities as specified herein.
