That at a regular and legal meeting of the Common Council of the City of Ken ova, in the County of Wayne and State of West Virginia. held ou the 2ud day of October. 1916, the follow ugordinance •was adopted, passed and entered of rec ord by the unanimous vote of the mem bers thereof present, namely: J. S. Croseen, Mayor; ,T. W. Collins, Record er; U. G. Parsley, J. E. Staley, B. Hudgins, members of the Common Council. An ordinance authorizing the City of Kenova, in the county of Wayne and state of West Virginia, to borrow mon sy in the sum of Fifty-five Thousand .<$66000 00), Dollars aud issue and sell its bonds to raise said amount, for the purpose of constructing aud installing sewers and a sewerage sys em in the streets and alleys of said city, including mains. laterals, conuectiouB, traps, and other necessary and convenient accesso ries to a modern, sanitary and efficient sewerage system, and to provide a maxi *nnm bond special levy of 22 cents to pay the interest on said bonded iudebteduess and provide a sinking fund for the dis charge of the principal in the number of years authorized by the issue of bonds. &elt Ordained by the Common Council of the City of Kenova: Whereas, It anpears to the common council of the City of Kenova, in the ■couuty of "Wayne, Mate of West Virgin ia, that in order to provide a modern, aanitarv and efficient sewerage system in aud for said city it is necessary to issue bonds in the sum of Fifty-live Thousand ($65000.00), Dollars us piovid .<td by Chapter 89 of the Acts of the Leg sshtture of the state of West Virginia, session of 1913, aud otherwise provided by law, in order to procure money for the purpose of constructing aud install ing sewers and a sewerage system in the streets and alleys of said city, in eluding mains, laterals, connection*, traps, and other necessary and conveni ent accesso: h s to a modern, sanitary and dent sewerage systm ; and, .Vihereas, sai l City of Kenova has •more thuti one thousand inhabitants; and, Whereas. It appears and has been de termined that this said proposed bonded indebtedness, together with and includ ing the present existing indebtedness, does not in the aggregate exceed five per c ntum of or on the value of the tax able propei ty in said city as ascertained by the last assessment for state aud •county taxes; Aud said common council being of the -opinion that the maximum rate of levy provided by law, or heretofore provided for in "he manner provided by law, will not produce sufficient funds to pay the interest on said bonded indebtedness and provide a sinking fund for the discharge of the principal iu the numtx-r of years authorized by the issue of said proposed Ponns without laying a imiximuin sped ul bond levy, as her*'iuaiter mentioned, to pay the interest and provide a sinking fond. The bonds issued un er this ordinance shall be known and designat ed as “THE 1915 SEWERAGE BUNDS.” They shall refer on their face to Chapter 141 of the Acts of the Legislature of the State of West Vir ginia, session of 1872-8, us amended bv Chapter 91 of the Acts of the Legisla ture of the State of West Virginia, ses sion of 1897, and to said Chapter 89 of the Acts of the Legislature of the State of West Virginia, session of 1918, under which they are issued, and shall con tain a reservation of the right of said city to pay off and redeem the same, or any one or more of the same, after ten years from the date of issue, as provided by this ordinance ; and shall also state that provision has been marie for the collection of a direct aunual tax to pay annually the interest thereon and the priucipnl thereof within and not exceed ing thirty years. Sec. 6. Said bonis, after having been advertised in some convenient newspa per for four weeks previous to said sale, shall be sold at public sale to the highest bidder in writing, for cash, at not less than their par valne, and the proceeds arising from said Bale or said bonds shall be used for the purpose of constructing and installing seweraand a sewerage sys tem in the s'reets and alleysof said city, including mains, laterals , connections, traps, and other necessary and conven ient accessories to a modern, sanitary and efficient sewerage system. Sec. 7. A direct annnal tax shall be levied and collected in said city, suffi cient to pay annually the interest on said bonds and the principal thereof within and not exceeding thirty years from the date of said bonds. And it appearing that the same is nec essary in each year to pay said interest and to provide said sinking fund, for said purpose an annnal maximum spe cial bond levy of 22 cents on the Une Hundred Dollars valuation of all the as sessable property in said city is hereby authorized to pay said interest and pro vide a siuking fund to pay the principal as provided by law. Sec. 8. Said tionds shall be subject lo redemption after ten years from their date, at the option of said city. The Re corder of said city, by order of the Com uiou Council, shall each year give notice, by publication, to the holder or holders of the bonds to be redeemed that on or af ter a day named, the designated bond or bonds, with any accrued and unpaid in terest, will be paid upon presentation; that if not presented, they shall cease to bear interest after the last publication I of sail notice; that said notice shall be publishe t for four successive weeks iu one or more newspapers published in said City of Kenova or of general circu lation in said City ot Kenova, prior o such designated day of payment. Sec. 9. The lnonev so levied and col lected to pay the principal and interest on said bonds shall be applied to that purpose and no other. Sec. 10 Said bonds shall not bo Is sued or sold unless all questions connect ed therewith shall have beeu first cnb mitted to the qualified voters of said City of Kenova at an election dnlv call ed and held for that purpose and shall have received three-firth* of all the vo es cast for and against the same. Sec 11. Therefore, pursuant to the foregoing ordinance, I, J S Crossen. mayor of the City of Kenova , County of Wayne and 3tate of W -st Virginia, do hereby call an election and appoint the 6th day of November, 11*15, between the honrs of si nrise and sanset of that day, at the voting places in and for the vari ns elec tion precincts in said city, as the said voting places and said election precincts have tieen designated and determined in the manner provided by law, as the time and places at which an election shall be held by the qualified voters of said city of Kenova, to decide whether they will ratify or reject the foregoing ordinance and the issuance and sale of the bonds as therein described, and authorize the maximum special bond levy in said ordinance described, and the ballots used in said election shall be prepared and all other things done in conformity with the said ordinance. The aggregate amount of the indebt edness of said City of Kenova, County of Wayne, W'est Virginia, uow existing and authorized is as follows: Bonded indebtedness, $40,000,00 Other indebtedness, None The value of the taxable property in said city as ascertained by the last as sessment for state and county tuxes is $2,165,812 00 Given under my hand, this 2nd day of October, 1915.
