I j SALISBURY'S REPLY TO SECRETARY |A EYARTS. He Thinks Our Secretary's Reasoning is A Powerful, but Does Not Want to f Follow Him in His Arguments. Washington, November 17. ? Lord la Salisbury In reply to Secretary K virtu' I dispatch concerning the Halifax Fish- P! ery A want attar recalling at a considerable length the circumstances which led f' to the organization of u Commission, and c: the grating of thedeeiaion given by a ma- t{ jority of the Commissioners, says "it was |V not without most thorough and laliori-. *j ousinvestigation of the question sutunit- |i ted to their appreciation, tliat a majority JK of the Commissioners arrival at the <le-' fj [ cision quoted, and it must be observed, V the whole proceedings were held in 1C | strict conformity w ith the terms of the f treaty of Washington, whilst the ? award wasgiveu fey a majority of the Cora- K nussioners in the very terms contained W in article 22 of the treaty. In the dis- w patch eoiumuaieatod to Her .Majesty's P* Government, Mr. Evarts seeks to invalidate the award which is at the root of this exhaustive investigation, utwm the ? ground that in estimating the claims of jfj1 (ireat Britain, the Commissioners must J**1 i?e assumed to have taken into consid- y'1 eration circumstances w hich the treaty ;n< of Washington had not referred to them. P. .? t? t ,i... in 1 IhTt* IS Homing Oil me iwr ui inr m award which gives any countenance to jC1 tin* supposition that the Commissioners I V tiaveled beyond the limits assigned r*11 them bv the treaty. j*1 Mr. Kvarts' argument in favor of this " contention is entirely deducted from what he considers to l?e the magni-. . tude of the sutu awarded. It . is, he contends, so far in excess of what f" the United States government believes *' to In* the true solution of the problem , submitted by {he tripatv, that some factor which the treaty has not recog- JjL* nized, must necessarily, in his opinion, *' have lieen Imparted to the calculation. Mr. Kvarts proceeds to give, in detail, the consideration by which, in his ,n judgment, the result arrived at should U* tested. He gives his reasons for lielieving that mackerel is the only fish to whose capture, in the waters ojiened by tireat I treat Britain, any value shoulj^ fr< be assumed, and that no account is in to Is* taken of herring, halibut, nst, be lake, pollock or bait fish. He computes A1 the numls-r of mackerel which the nv I'nited States fishermen have caught ??" within the three mile line during tlw pr years oi the treaty period which have p expired, and infers front it the nuntlier u which they are likely to catch within Tl the sitme area during the interval that fai remains, and concludes this branch of his argument by estimating, on various th hyjHtthesis, the profit which the I'nited ?xi States fishermen are likely to have made b> from the mackeral which they have probably caught. Mil the other side, he estimutes :U a high value the profit which the British fishermen have de- ,ni rived from opening the markets of the ,.u I'nited States and concliules that the \| sum fixed hv the award is so much larger than these considerations would have justified, that the United States government can only explain its magnitnde on the assumption that the commission has mistaken the question that was referred to it; that Mr. Kvart's reasoning is jxtwerfnl it is not necessary for me to sav, nor on the other j,| hand will he be surprised" to bear that Her Majesty's government still retain t,|, the Itelief that it is capable of refuta- p| tion, but in their opinion tbev would ({l not i)e justified in following him into )| the details of his arguments. These n| very matters were examined at great ,.t) length and with conscientious scrutiny ,|t, by Commissioners whose awanl is un- *|, der discussion. A decision of the majority was given after a full hearing of all considerations that either side w as able to advance, and that the decision w ithin limits of the matter submitted !''' t<i them is. under the treatv. without appeal. The argument of Mr. Kvarta contends that the sum awarded is ^ excessive, and therefore the award ' must have heen arrive*! at hy Home ill*'gitimate pr<wess, hut to argue against K the validity of the awunl solely on the J? ground that the conclusion arrived at \ by the arbitrators on the very point re- | ferred to is erroneous, is in effect the i .. >anie thing as to dispute the judgment .
