(ï. aiwJ «feMMlbn - I ÜMflUMkY, iltfVIJUUUI îttTIHM. j A RUIT!: ITION AS1) LITIGATION. | The London chamber of commerce re cently adopted tie following significant res- i o'ution: 'That this meeting request the council ot the chamber to nrçe Vie foreign | office tocoauij^icmte with the governments ef all th* States in which tribunal* of com- I merce «re in operation, requesting the m to Iritg in a law or to take s eh steps as mar I be Cf cesfarv to make arbitration clauses. ' lhe uninitiated in commercial lite may cot at once see the drift of this resolution, but when we say that it is a movement in the direction ot abating the nuisance and leases of litigation in the business circlcs of ' the world thes will appreciate its import ance. We believe it was of a lawyer that Peter the Great, of Russia, while on a visit to western Europe, said that he had but one in his empire and he proposed to hang him when he got home. Such a summary dis position of a very learned and, in many re. sptcts, noble profession would not be advisa ble in the existing condition of society. More or less lawyers—'ess, or fewer, rather than more—will ue needed for some time to ccme, but there can l>e no question that a vast Hiajority of the members of this pro fession would be more useful to the world and would do Ie:s mischief it they fol lowed other avocations. Proba'jly, however, thev do less harm as the interpreters of the 1ait, and as counsellors and advocates than they do as le,^v»lators. What Solomou said of boohs is true of stat utes, of the making of them there is no end. Scores and hundreds of enactments are spawned upon society every year in ever* ( . legislative chamber. In addition to these we have the rulicgs an J d&isions of courts ; which, very coma.o..ly aro treated as il : tyty wire laws in tho-aelres, being ro gardtd as the iuterprc'alio't ot Uw; a rl ail this rast -gg ^ute of statute?, ralijgè ni.d decisioas is 3appo? d tj be put in the keepirg of the l-g.»I fraternity to b-j em ployed for the defense aud welfare o! j —in«. Now th» question Rîggestxl by h»» r»?s » iution adopted by the London Chamber o • lotacme i? Can society get ab>n* with fi'Vtr U«tt&il loi l««t«>3? Is there not ' la cncnnoui excess of litigation ' Would it net be *U<? to take steps for the uiscoar a.~tnwnt of litigation? So fas as rhe kst •sqoirr coaccrn* tfee business life of the world it i-* imnitestly the opinion of the Loa- ! don Chamber of Commerz that i it ilculd î»e is:«r«4 in the atfifm- ' ative. We can r.ot, of course, expect j t.. r frit nds. the lawyers, to take this vie* of the matter. Tbtir livelihood and pro'perity depend upon litigation. The more disputes j over wills acd bills, over contrats and ; lease?, over notes and mortgages, over très ' psies and infringnnebts, the b«Uer it is for them. It is natural therefyre, that many ' —bat not all—should encourage quarrels ! atd litigation. There are members of the j profession who will not use their iutlnence i for the miserable worii oi fomenting wrang ! ling and dragging neighbors into law suits with each other. There are lawyers who have made it a nie to recommend settlements, especially between individuals who would be embarrassed by the payment of fees, costs and po««ibly heavy judgments. These men are an honor to their profession and to society. They are generally es teemed and patroai/.ed according to their worth. On the other hand, there are many lawvers who, if they do not incite quarrels show no disposition to allay them except through the expensive proce-ses of litiga tion. The wise and prudent man never begins or contests a lawsuit if there is a feasible way of adjusting the difference in dispute without one. Arbitration is steadily grow • ing in popularity as a substitute, especially in commercial circle«. Perhaps ia this way, as in many others, commerce is goinj to prove a blessing to society. Who Did It? A", r. Sun. • It was not the Democracy. They were divided and discouraged. A vasi proportion "fcf rfeem would not have Mr. rievelaml. and voted against him. Yet the I>emo<.racy furnished the great body of the voters who supported him. Atone they could not pos gib\v elect him ; but if they had not voted lor him, he could not have come near being elected. It vm not the Independent Republican*, so called. They were loud and active and free with their money—in the way of legiti mate election expenses—but they could not win a victory. Manv as there were, there were not enough of them. It was a handful ot unforgiving Stalwarts that did it. They made no noise before hand. They had no organization. They held no public meetings. They sen; out no cratcrs. They printed no documents. They said nothing until the very eve of the elec tion. But they voted. They remembered the defeat of Folger. They also remembered Mr. Blaine s assault njx n Senator Conkling; and they votfd so as to ma&e the old ac count square. Their votes, along with those of the regular Democrats and the In dependent Republican«, were ei'ieacious. Study the returns of- Oneida county, where Garfield's plurality of 1 D4G was changed into a plurality 0» -> for Cleveland, and you will see ho»- it wts »'cue. It seems a funny idea, but the fact is that after having served the Blaine men as a bludgeon to<knock Folgt r over. Cleveland has now been made to ser.*e the Stalwarts as a clever to eut down Blaine. The bachelor gets through this world without^-xperiencing many of the delights of tax-paying unless he chances to be a man of great wealth. That thi-s is wrong is shown by the promptness with which a newly married man tinds himself a tax-payer when he most needs his money for the use of his family. The discrimina t'on against the man who assumes the re sponsibilities of supporting a family and is 'aver ot the man who lives only for himselt is an irjustice which ought not to be toler ated. '1 he bachelor finds a premium pat •jpea his own worthles3ncss by the society ot which be forms an insignificant part. He sees his companion or acquaintance, who cht oses to become an honorable member of sciiety, loaded at once with public as well as private burdens, and he will need no one to tell fcim that the support of a family is ordirarily difficult enough without the im pesition of uncallèd-for taxation. Let the brchelcr be taxed or licensed. Put a pre m it. m on him.
