Butit seems rather a strong measure to lu.d that a man who, before the homicide that he committed was of perfectly sound mind; and who appeared before the jury in a most unquestionable state of sanity, com mitted that homicide under the influence of madness. It looks as if the crime had been made the proof of the madness which excused it. Be this as it may, we are not about to in sinuate any censure on the verdict or the Ameri can jury, because we are very much inclined tu believe that a jury of our own countrymen would have arrived at a similar conclusion. If we wish to eliminate the doctrine of "Served him right" from the decisions of courts of jus tice, we must devise some tribunal less open to popular influences and prejudices than that pal ladium and pride of our liberties, n British jury. But while we freely admit that the con clusion was one at which, however contrary to law it may be, any twelve ordinary men were almost certain to arrive, we must say that the whole circumstances attending and following the verdict of acquittal, the license allowed to the bar and to the audience, ami the demonstra tions of popular opinion which followed, are not calculated to elevate free institutions in public estimation. We cannot forget that though Mr. fsickies may have many claims O'l the compassionate allowance of all "who justly estimate the weakness of human nature, he is not an example to be followed, not a hero to be admired, but a misguided man, who washed out a grevious offence in the blood of his enemy, slain in the open day in the public street, with out the possibility of defending himself, anil with every circumstance that could show a fixed and ferocious determination. Casuists limy diller as to the precise amount of guilt, romancers may deck out the crime witii the attributes of heroism, but sober reason! must still regard the act as deeply censurable, if not highly criminal, and its result as a misfortune to its perpetrator scarcely infeiior to that which he inflicted oir his victim. 1 his being so, we confess we are sorry to hear that the verdict of "Not Guilty" was" re ceived with a "loud, wild, thrilling, tumultuous hurrah" from the spectators, with cheer after cheer, the waving of hats and handkerchiefs, and a general rush towaids the dock. The audi ence believed, no doubt, that they were making a vigorous protest against adultery; butit may also tie questioned whether they were not, in their zeal for the seventh commandment, lend ing their applause to the impunity that wai'eil on a breach of the sixth. The Marshal and the Judge seemed to have been alike unable to ar rest the tumult. Mr. Stanton, one of the pris oner's counsel, moved tor his discharge before the verdict was recorded, and, in the name of Mr. Sickles and ot his counsel, returned thanks to the jury. We certainly remember to have read, in the reports of the infamous tiials of persons accused of the Popish Plot, that judges were in the habit of telling jurios that they had acted as gcod subjects and as good Protestants when, on the evidence of Gates or Bedloe, they sent some unfortunate gentleman to the halter or to the block, but we never before heard of the counsel for a prisoner thanking a jury, on behalf of his client ana himself, for their ver dict, as if they were electors at a poling booth. I f that verdict was just, the jurors were entitled to no other applause for the discharge of their duty than that of their own consciences; if un just, they were entitled to the re; robalion i?f ail good men. In no case could the idea of* any personal obligation from the prisoner to the jury be entertained; the very notion ef such a thing was io itself a:i insult. Little, however, cared "the stentorian Stan ton" for these things. Turning from the jury, I he addressed the crowd in a very pithy piece of forensic eloquence. "Now go" it," said the barrister, and the enthusiastic crowd "went it" accordingly with another pea! of shouts. Mr. Sickles was kissed by his friend Captain Wiley, and overwhelmed with congratulations, as if he had achieved some exploit more than ordinarily gloriou.-. On his slow but triumphant passage towaids the door he had to pass by the jurv bo.\; the jury expressed a wish to congratulate him; he stepped over the forms to meet them, and their salutations were heartily tendered. Then the counsel for the defence exchanged complements and congratulations with the jury. On emerging from the court Mr. Sickles was welcomed with a fresh volley of cheers from tiie crowd. Of course, he was immediately called upon for a speech, but by this time he was so much exhausted by the excess of popular en thusiasm that he was unable to comply. A desperate effort was made to take out the horses and tn draw him home in triumph. We cannot prevail upon ourselves to regret that this well meant attempt was unsuccessful. The house in wiiich Mr. Sickles was deposited was surrounded by thousands of people, and so much diii this ovation appear to be to the taste of its principal object that Mr. Sickles in tends to remain in Washington f ir a week. The counsel who defended him received the compliment of a serenade, and as they, on behalf of Mr. Sickles, declined the honor for him, public enthusiasm could find no other vent than serenading the jury. Then we have the sayings and doings ot the jury; how they came to Mr. Brady's parlor at the National, and con descended to unbend 011 the subject of their verdict. Mr, M'Dcrmot spoke of his devotion to the family altar. Mr. Knight brought his tiddle with him; with which he hail solaced the long nights of seclusion which thejury had to pass, and played several airs to the audience in Mr. Brady's parlor. Mr. Arnold, the foreman, hopes that his latest posteiity will tumor his memory for having served on that jury; Mr. Hopkins, "the wng and mimic among the jury," informed Mr. Sickles that had Mrs. Hopkins been in question he would have brought not merely a pistol but a howitzer to bear on the seducer. The jailer wept; Mr. Brady of the pal lor, one of Mr. Sickles' counsel, turned pale Mr. Phillips cried like a child; and "Mr. Meag her, of the sword," in the exuberance of bis heart, clapped people on the back and asked them if it were not glorious. The guests at ?1 i-laid's hotel stood up and shouted before dinner, and an orange vender presented Mr. S. with a box of his fruit as a token of sympathy. There is, no doubt, much honesty and hearty ' feeling.-it the bottom of these coarse and noisy de ' uionstralions, but therms also a deplorable want of decorum .ind self-respect. Mr. Sickles, after ?ill, has not saved his country, has not a ttended her institutions, or vindicated her laws. He has, under what may be considered an intolerable provocation, sent an erring fellow-creature to his !a>t account, without one feeling of mercy, without one moment of respite. For this he receives applause and congratulation such as no living American citizen, however fair and untainted his character, has been thought wor thy to receive. It is nl>o a d stinguUtied merit of trial by jury that the jurors come from the body of the people, anil return to it when they have discharged their duty, unknown and un questioned. Bat here we have the jurors made the objects of a public ovation, their words treasured up as oracles, and their m?t insignifi cant acts chronicled with a morbid avidity.
