A Bird Which Assists the Rice
Planter By Protecting Lsvees.

In southwestern Texas and. other
riceplanting regions the little blue
heron or" levee walker (Ardea
coerulea) alights on the levees which
surround the fields. These levees
yarr in height from a few inches to
3 or 4 feet. Along these plantation
highways . the herons are seen to
strut with considerable ostentation,
varying their parade by darting
ioccasionall)' toward the base of the
levees. The habits of these birds
engaged the attention of the visiting
scientists from Washington who
jvere studying rice culture.
One of the greatest difficulties to
be overcome in rice irrigation has !
been the frequency of washouts
along the levees, which result in
widespread destruction of proper
ty: breaks and washouts would
occur.
JS'aturally birds like the blue
lieron, with strong, spearlike Leaks,
came under suspicion. Their
pompous marching on the levees
intensified the disrepute in which
they were held.
It is now known that the damage
that is done has been effected by
crawfish, who bore through the
levees and thus, start leaks, at first
o small that they escape the at
tention of the patrol, but which
this would reduce the offense to
murder in the second degree and
might he considered in mitigation
of the penalty for that degree, but
would not wholly excuse the crime;
but if the temporary insanity was
produced wholly or in part from
any other cause, and if while in
Such insane condition he commit
ted the deed the defendant would
be guilty of no offense. It was also
charged that if the jury believed
that the confession was not a vol
untarily confession and made after
statutorT warning that the state
ment would be used against Irm, it
should be disregarded and the case
considered only upon circumstan
tial evidence. v
All tho witnesses,, numbering
about sixty-five, were excused Fri
day night and most of them return
ed to their homes today.
