On motion the resignations of N Esbeck, as county recorder, and Woodward, as clerk of the district court, were accepted and O Donald son was appointed recorder and Hill clerk of the district court, under the following resolutions: Whereas, There may some question arise, growing out of what is known as the Titus amendment to the constitu tion, as to when the clerk of the dis trict court, elected at the general elec tion, held November G, 1900, would take his seat and assume the duties of said office, under his said election and qualification thereunder, and Whereas, The said office of clerk of the district court is now vacant by the resignation of Woodward, the person last holding said office. Be Ft Resolved, That the importance of the duties incumbent upon the holder of said office demands that it be forthwith filled and that to avoid all questions as to the right or Hill to hold said office from this time until the next election of clerk of the dis trict court, he be and hereby is ap pointed clerk of the district 'court of Audubon county, Iowa, from this date to the time his successor is elected and qualified.
