(By The Associated Press) WASHINGTON, D. C. Oct. 10, John Ogden of Indianapolis, lost his Supreme Court effort to com pel the U. S. Treasury to redeem in gold, the Fourth Liberty Bond issue which he held to the extent of six thousand dollars. The tribunal refused to review the decision of the U. S. Court of Appeals for the District of Columbia, dismissing the litiga tion. Government attorneys contend ed it was a suit against the Un ited States Federal Government, which could not be sued without its consent. The Treasury refused to re deem the bonds in gold, as it did in another case which the gov ernment won in the review of its contention against payment in gold in cases of Liberty Bonds when the Treasury call for their redemption. AFL Approved Attack On CIO Area In West (By The Associated Press) DENVER, Oet. 10, — The Am erican Federation of Labor con vention here approved the Fed eration’s first invasion if the ter ritory claimed by the Committee for Industrial Organization, with out a dissenting vote. The convention approved the report of its resolutions commit tee’s action in approving the char ters of the Progresive Miners of America, Blue Card Union of Ore Miners, in the tri-disitrict re gion. of Missouri, Oklahoma and Kansas. SUPREME COURT DENIED MOTION UNSEAT BLACK (By The Associated Press) WASHINGTON, D. C„ Oct. 10, —The Supreme Court refused to permit Albert Levitt, former fed eral judge of the Philippine Is lands. and Patrick Henry Kelly, Boston attorney, to contest Hugo L. Black’s right to a seat on the nation's highest bench. Has Clear Title This action gave Justice Black ‘ clear title to his judge post, so far as the present challenges are concerned. Other Proceedings Levitt indicated, however, that he might start other proceedings. The court refused to permit Levitt to file his petition which contended that Black was consti tutionally ineligible to the posi tion. San Francisco was scheduled to lead Division Seven ot the Navy’s scouting force after emergency supplies had been hastily loaded aboard. Bomhardmeut Madrid Heavy Last 24 Hours (By The Associated Press) MADRID. Oct. 10, — One of the heaviest artillery battle* heard on Madrid fronts in mon ths, was turned into a general shelling of Madrid itself Shells dropped all over th® central area of the city, several hitting a block from the building in which foreign correspondent® work. Battle was Begun The artillery battle begun ab out midnight with the govern ment’s extensive shelling of in surgent positions south of the city. The heaviest engagement ap peared almost directly south of Madrid where insurgent were re pairing a road. The exploding of shells and bombs continued thru out the night until early this morning. .1 -t
