EXHIBIT "A" This Indenture, Made this 3d daV of March, 1914. between the Santa Fe Land Improve ment Company, a California corporation, hereinafter called the "Improvement Com pany," and the Town of Flagstaff, a mun icipal corporation of the State of Arizona, hereinafter called the "Town," Witnesseth: That the Improvement Company, for and in consideration of the sum of Ten Dollars ($10.00) gold coin of the United States of Ame rica, and of the execution by the Town of Flagstaff of the agreement hereinafter described, and of other valuable considerations, to it in hand paid by the Town, receipt whereof is hereby acknowledged, does hereby grant, bargain, sell and convey unto the said Town, its suc cessors and assigns forever, all that certain piece and parcel of land situate in the County of Coconino, in the State of Arizona, and par ticularly described as follows: All of Section 27, in Township 23 North, Range 7 East, C. & S. R. M. Also that certaip piece and parcel of land situate in said County and in said State of Arizona, particularly described as follows: (Here insert description of site for New Reservoir.) Together with all the singular and tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof. And does hereby giant unto the Town all the right, title and in terest of said Improvement Company in or to the waters of any and all springs rising on said Section 27, and of any other spring whose waters are now used, in whole or in part. Also all the right, title and interest of said Improvement Compa ny in or to any lands within the hereinbefore described right of way. To Have and To Hold, all and singular," the said premises, toge ther with the appurtenances, unto the said Town, and to its success ors and assigns forever; Provided, Always, and this indenture is made upon the express condition, that if the said Town shall be in default after sixty (60) days' notice of the default and demand of performance, as provided in Section 6 of Article III of that certain agreement in writing bearing even date herewith, wherein said Town is named as party of the first part and The Atchison, Topeka and Santa Fe Railway Company is named as party of the second part, and said Improvement Company is named as party of the third part, a copy of which agreement is here to annexed, marked "Exhibit A" and made a part hereof then this in denture shall be void and the said,premises and property, rights, in terests, tenements and hereditaments, and all the singular thereof, shall be forfeited unto and shall revert unto and become the absolute property of the said Improvement Company, its successors and assigns, who may enter into possession, thereof and put out and re move the said Town, its successors or assigns, and any person hold ing under it or them.
