Friday morning had breakfast; staid around the house awhile; got two horses above the house; saddled one; went to Mr, Thompson's and got a saddle he bor rowed from Mr. Campbell; came to town ; staid all day; returned about 5 o'clock in the evening; sat around the house until about 8 or 8 o'clock then went to lied; slept there all night. Mayhew got a mare there; came to town and staid about three hours. After dinner went to the ditch above the house to take a wash. In about an hour was arrested by Mc Donald and Rogers. I never was ar rested before; was in Pha-nix on the night of the 11th returned alotit 5 o'clock; wasn't in town any more that evening or night ; slept with Ma hew io a room ; didn't leave the room that night. Brawley's testimony was substantially correct. Osltoruc's cor rect except we told him lie were go ing for the meat and the fna ud the pleasure of the trip. Sidney Smith wanted to lxrrow a gun in Morgan's store; also asked for cartridges; did not ask for any pistol balls; wanted guns and ammunition to go hunting; have a shot gun, Spencer ritlcanda six-shooter at my house; gun hasn't bcea used for four or live otonthx, the hammer of the shot-gun was broken. Horses have lx-en running on Os borne's wheat for alnwit a monta ; had intended going hunting down the river about 50 miles. Osborne told us the Verde would be a good place, so we determined to go there if Mr. South was willing. I saw a belt Sat urday morning before Mahew left. It was my belt, I left it under the bed. It was wrapped around the scabbard : pistol was in the scabbard; was in Morgan's store between 3 and 4 o'clock. Asked for a gun, also carl ridges I did not ask for ronud balls. Xo one was present during my con. versation with Mr. Paul. , Frank Mayhew made a':-tatcmem which was substantially the same as made by Ilickey. Mrs. Martin's testimony wu to the effect that the defendants did not leave the house that night, at Iea; while she was awake. Thos. G. Webb did not think the horse's tr.acks were made by Iltck ry' roan horse; did not think the men tracks made, were tho.-; of Ma. feew's or Hicfcey's boots. T. C. Hayes, W. A. Isaac Hickey father, of defendant testified as to the boys being in bed after ten. and also when he arose; went near the robbery and saw horses' tracks; could not recognize either of tracks as being mad by the grey horse or fte roan ; paf7 mens' tracks didn't take track to be those of Trice Hicke-. On uswroing after robbery, went across nverto meet ray wagon. Melinda J. Hickey testified as to being home on the night of fee lltfe. Lou Teale, teamster met old Mr. Hickey near Broadway's on the morn ing after the robbery. He inquired if I had nc-cn his son Dave. He had one hor?e2t the time. S. A Smith was with defendants most all Friday, ,' aw them la.-t about 5 o'clock that night. W. D. Hickey was over the Gila after a load of wheat on the nigbt of robbery. Could not recognize the horse tracks s those of my father's horse or the bot -tracks as those of my brothers. The defense then rlo.-ed.
