be remembered that in many in
stances the scope of the Legislature
is limited by reason of the Ogranic
Act or Constitution of Alaska,
which is composed of more“DON’TS
than DOES”, still there remains;
much to be done, but proper Legis- 1
lation fs not the work of snap judg
ment or personal wishes but the re- !
suit of thought, study and a review
of the results obtained in other j
jurisdictions under simular circum- j
stances.
“There is no question that much j
remains to be done and it is one of
the paramount duties of the in
cumbent of the office cf the Attor
ney General to work with the Leg
islature in a spirit of harmony to
this end. I have for some time be
lieved that our probate law needed
attention but I do not believe that
Mr. Rustgard has found the pana
cea that will bring about the mil
leniurri in this regard. As I say
there is room for improvement
here, out there is some quest >n as 1
to whether the present law with

“One of the planks in my plat
form, or reasons why I seek election
at the hands of the voters of Alas
ka is, that I believe that so long as
the Organic Act shall remain the
Constitution of Alaska, that all ::
laws enacted thereunder by the i \
Territorial Legislature, and approv- 11
ed by the Governor, should receive j
at the hands of the Attorney Gen- j j
eral such interpretation as will
support and give effect to the in
tent, objects, aims and purposes of
the enactment, without regard to
the particular district or division
applicable. This the present in
cumbent has not done but on the
contrary has usurped the functions
of the courts and ha? in two spci
fic instances nullified the wishes of
the people of Alaska as expressed
thru their duly elected Legislative
Representatives. I refer to his de
cision in the Matanuska road case ! §
and in the case of the subsidy of a '
small boat to serve the isolated
communities on the Cook Inlet
country. I have good reason to be- ;
lieve that his attitude in the case of ; [
the administration of the Pioneers’ !\
Home has hampered the bestowing j \
of the benefits of that law on more j
than one worthy pioneer who has::
learned his degree of “Sourdough” 11
■ several times over by his earnest
work in blazing the trails which we
i of a later generation are now able
to travel in confort. A narrow,

ern and Southwestern Alaska at
strategical points for this purpose.
