fcrnnlied for the gOrcrnment of the
District of Columbia becomes operative
on January 1 next without the incorpora
tion of certain amendments It Is belleted
that the result will be embarrassing to
litigants as well as to a number of office
holders
According to the opinion of many of the
leading members of the local bar the
tenure of office of the two Judges who
preside in the branches of the Police
Court will be affected so as to i auae va
cancies In those positions Other ofQicrs

The embarrassment which this condition
of affairs would produce has caused the
irsttcr to he given a great deal of seri
ous attention by the committee of the
Washington Bar Association which has
had charge of the formulatfon of the new
code With a view of obviating tho diffi
culties suggested numerous amendments
to the code as adopted by Congress on
March 3 last have been prepared and will
be submitted to the National Legislature

howctcr confronts thu committee is the
possibility that Congress will not take
any action In the premises before tbo
close of the year Only a few more work
ing days remain before the Christmas
holidays will begin and ccrlous doubt is
expressed It the matter will be taken up
for consideration
In the event that it is found to be im
posplbk to hsic the proposed amendments
Incorporated in the new code before Con
gress cdjourns for the holidays it Is said
that a bill will be offered proposing to
postpone the time of the code going into
effect until January 1 1103 This it Is be
lieved by many would be the best way out
of the embarrassing position

One thing is certain that unless there
It special lcglilation on the matter there
will be no trials by Jury In clthnr the
Circuit or Criminal branches of the Su
preme Court of the District during the
month of January 1C that is unless the
time of tho code going Into effect is post
poned
This status will be brought about by
the change provided for in the new codo
In relation to the drawing of Jurors The
present system by the terms of the new
codo has been abolished and the com
mission cniiKiwcred to draw the juries
will not rome into existence until after
January 1 noxL The law however pro
Tides that the names of the Jurors shall
be drawn at least ten days before the
beginning of the term This protislon
precludes the possibility of an act being
done by a commission ten days before it
comes Into existence An effort will be
made through special legislation how
Vcr authorizing that the jurors drawn
for the month of December shall serve
also during the month of January next
