Lvy. his associates and assigns, the right to construct, equip and maintain a spur track on Commandencia street between Main and Zarragossa streets, from the track of the Pensacola Electric Company, at a polr.t near Main and Commandencia streets to and alongside of Ills warehouse at the comer of MMn and Commandencia streets, and parallel to the same at a dis tance or twelve iz reet tnererrom. BE IT ORIVAINED RY THE BOARD OF COMMISSIONERS OF THE CITr OF PENSACOLA. Section 1. That thereia hereby granted to Jos. M. Levy, his associates and as signs, the right to construct. , equip and maintain, and to have car operated upon, a spur track from a point on that main track of the Pensacola Electric Company, near Commandencia street, to and alongside of his warehouse, at the corner of Main and Commandencia streets, said track to be Two Hundred and Sixty-eight (268) feet In length, and to terminate at the south line of Zarra gossa street, as shown on the plat filed with, and made a part of this Ordinance. Levy, his associates and assigns, shall so con struct th spur track that free passage over and along ths same for vehicles will not be Intercepted, and that cars shall not be allowed to stand thereon for a time longer than Is necessary to load or unload same, and the said Grantees agree. In consideration of ths foregoing grant, at au times to place and keep the space between the rails of the said spur track, and for eighteen Inches on each side thereof. In the same condition and repair as the city shall keep the adjacent portions of said street; and whenever the city shall provide for the grading, pav ing or improving of said portion of street the said Grantees shall at the same time. That this Ordinance shall be of no effect unless the acceptance thereof bv the Grantees is filed with the City Clerk within thirty (30) days after Its passage by the Board of Commission ers, and a failure on the part of the said Grantee, his associates or assigns, to file the acceptance of this franchise as hereinbefore provided for, or a fail ure to complete the tracks as herein pre scribed, shall operate as and shall en tail a forfeiture of the rights and privi leges herein granted. Section 6. This franchise and all the rights and privileges herein and hereby prescribed In Sections 15, 16 and 28 of granted shall at all times be subject to each and all the terms and conditions Chapter 6746, Laws of Florida.
