CHARLIE BUTLER COURT OF RECORD HEAltS ARGUMENTS IN A CIVIL SUIT The court of record- put in a long holi day yesterday in the hearing of a single case, and was obliged to adjourn for the day at the conclusion of the addresses of the attorneys to the Jury. The case was that of the Alger-Sullivan Co. vs. Theo. Baars, and revolves around the question as to w-ho should pay for cer tain Uimber and materials used in the ships of the Bullock-Caldwell Co., now In the hands of receivers. A decision, will doubtless be rendered this morning. A. W. Ranney and other members of the lumber firm are hero from Century to push the case. A. C. Blount and J. E. t. Tonge appeared for the plaintiff and Judge Avery for the de fendant. Jones has rendered an .opinion that all citizens whose names are on the recently compiled registration list may vote on that issue, since the matter ol issuing the bonds has already been de cided afirmatively. and the question now is merely as to the application of the funds. The bonds were originaly authorized to improve a tract of land in Mazent park for housing ship yard employes, but was nevw used for that purpose, it is now proposed to 'apply the fund to : nec essary street improvements; but this can not' be done until sanctioned formally by the voters. Since the question involv-d is so simple, there setm to be little ay prenension as to its passage. The prop-, osition will appear on a separate ticket from the name of Commissioner Hinrichs, who is up for reelection. STRUCK BY AUTO WOMAN IS MADE UNCONSCIOUS Mrs. A. Bargendall, who gave her resi dence as the San Carlos Hotel, was knocked down and rendered unconscious by the shock of an automoDile driven by Mr. Nupper at the corner of Paiafox and Ciarden streets at 9 o'clock yesterday morning. Mrs. Bargendall was picked up by the driver of the automobile and carried to Balkcom's drus; store. Dr. L. de M. Blocker was called and restored her to consciousness.- Her injuries consisted rf bodv bruises, ir-atrolmap. Mclntyre, wno saw the acident, states that the automo bile was moving about three miles in hour, and that Mrs. Bargendal stepped directly in front of it. Mr. Nupper had Just slowed down to allow a Mr. Eggart to get out. ' ATLANTA AREA IS NEAR GOAL IN CENTENARY DRIVE Jacksonville, Fla., May 30.-A total of fjJ71.BS4 was actually in hand in the Methodist centenary drive in the Atlanta area Wednesday afternoon. This was but $2,000 below the assigned quota. L. E. Piatt, area campaign director, was very optimistic concerning the outlook for success. In a statement given out Wednesday night, he de clared that he confidently expected the quota to be oversubscribed by. a con siderable sum. $94,000,000 has been raised In the nation-wide cam paign. This Is but $11, 000,000 below the quota. The Chattanooga area has subscribed astotal of $1,001,972 to date. This is within ' a short distance of . the goal, $1,291,200. J .
