The Memphis & Pensacola R. R.
Co. yesterday appealed the Judgment
rendered against them on Mar 29 bv
I the U. 8. district court for $11,000
in favor of the city of Pensaola.
Through their lawers, Sullivan A Sul
livan, the bonding company for the
railroad, the United States Fidelity
and Guaranty Co., has taken the case
to the U. S. court of appeals for the
fifth circuit, in New Orleans.
- Judgment . was awarded the city of
Pensacola. through failure of the. rail
road to live up to the conditions of
the grant In not completing construc
tion within a specified length of time.
The railroad claims . that tits city
had violated the contract by jelling
bonds and building on part . of the
right of way during the time the road
was in the course of construction,
thereby interfering with the ; work.
They further claim that , an require
ments of the terms of the - franchise
had been complied with until the city
Interfered with them in this mitinsr.

Manistee, Mich., plans to celebrate
Independence Day by ' launching - the
first ocean-going 1 vessel ever built
at the shipyards in that city.
The annual convention of the Texas
Good Roads Association will open at
Corpus Chrtiti today and continue in
session over tomorrow.
