A AS STATE DEPOSITORY Jackson, Governor Noel would not permit the substitution of a surety bond for the municipal bondB It had deposited in the treasury as security for the state funds, the First National Bank of Greenwood has resigned as a state de pository and asked that its securities be returned. The state depository commission, composed of the governor, attorney general and treasurer, has taken no action on the request, but the pre sumption Is, in view of the fact that two others have already withdrawn their securities, that the request will be complied with. The case presents some odd com plications. In the first place, the bank once offered a surety bond, but withdrew It when it was announced that Treasurer Edwards would not ac cept them unless forced by the courts to do so. They then offered muni cipal bonds, which were accepted, and were to pay three per cent Interest sayB the Interest rate of either this or another Greenwood hank was re duced when the change was made from surety bond to municipal bonds. The Greenwood In stitution decided to take the latter course. Attorney General Stirling, who has just become a member of the commis sion by virtue of his recent appoint ment as attorney general, Is doubtful of the wisdom, as well as the legality, of permitting the depositories to re sign and withdraw their securities. He regards their application, selection and depositing of securities as in the nature of a contract, and Is inclined to the view that they should be re quired to stick td their jobs. He ad mits, however, that he has had little time to look into the matter and, no't having had any connection with the former transactions of the commis sion, he is not certain of his posi tion.
