PLANS AND SPECIFICATIONS
Under Which Contractors Will Work lor
Next Three Years.
Section 1. It is ordered by the
Board of Supervisors of DeSoto coun
ty that the contract system of work
ing roads provided for by Sections
4465 to 4475 inclusive of chapter 123,
code of 1906, be, and the same is here
by adopted for DeSoto county, to be
come operative on January 1st, 1908.
The said roads shall be let as provided
by law, and according to the follow
ing plans and specifications, and as
classified, and in links as set forth
herewith. The clerk is hereby or
dered to advertise as required by law
for bids to be received at the October
meeting, 1908, for the working of the
said roads, the contracts to begin
January 1st, 1909, and end December
31st, 1911. The roads in the First Dis
trict to be offered in three lots, as
follows: "Division No. 1 to comprise
all the territory from the Tennessee
state line to the South line of the
second tier of sections in Township
two; Division No. 2 to comprise the
territory from the last named line
South to the south side of the first
tier of sections in Range three; Di
vision No. 3 to comprise all the re
mainder of the roads of said district,
and each road in these divisions to
constitute a separate contract, or
item.
The roads in the Second District to
be offered in two divisions, as follows:
Division No. 1 to comprise that part
of the Jeremiah Lodge and New Hope
roads running North and South and
all the roads in the second district
East of these roads; Division No. 2 to
comprise the remainder of the roads
in the second district, each road con
stituting a separate item.
The roads in the third district, to
be let as a whole, as a whole, as also
the roads in the Fourth District, each
road to constitute a separate item.
The roads in the Fifth District to
offered in two divisions, as follows:
Division No. 1 to comprise all the
roads lying West of the Illinois Cen
tral Railroad; Division No. 2 to com
prise all the roads lying East of the
said Railroad, each road to constitute
a separate item.
Section 2. The contracts are to be
let to the lowest responsible bidder,
who shall enter into bond in double
the amount to be paid him for work
in any one year, to secure the faith
ful performance of the contract.
Section 3. Roads of the first class
shall be worked not less than sixteen
feet wide, actual trackage, exclusive
of side drains, and shall have a center
elevation of not less than six inches
nor more than twelve inches, the
lesser elevation applying to hill roads
and the greater to bottom roads, and
shall be kept free from mudholes,
washes, ruts, rough stones, brush,
etc. A side drain shall not be less
than two feet wide at any place.
Section 4. Roads of the second
class shall be worked not less than
twelve feet wide, and with a center
elevation of not less than four nor
more than eight inches, and other
wise as roads of the first class.
Section 5. Roads of the third class
shall be worked not less than nine
feet wide, with center elevation of
not less than two nor more than four
inches, and otherwise as roads of first
and second classes. But no road of
any class may be narrowed down
from its present width.
Section 6. The contractor shall re
move or repair at once any total ob
struction to travel, and it is the duty
of the Supervisor to employ other
party to do this work when the con
tractor does not or cannot do it at
once. In case of partial obstruction,
such as mudholes, washes, ruts, etc.,
the contractor shall upon being in
formed of the same, repair such place
as early as possible, but shall not
defer longer than five days, and if
such repairs are not done within this
time, the Supervisor may employ
other party and have the cost entered
a charge against the contractor
upon the link of road on which said
repair is done.
Section 7. The contractor shall
build and keep in repair all culverts
and bridges under twenty feet irk
length, using for flooring on same
lumber sixteen feet in length on first
class roads, and twelve feet on all
other roads; he shall also repair all
breakage in flooring or hand rail or
boards on county bridges, the county
in each case furnishing the material.
Broken ffooring shall be taken out—
not patched. If the Supervisor pre
fers to use tiling at any place, the

Section 8. The contractor shall
keep roads at approach of all bridges
level with the floor of same.
Section 9. The contractor shall cut
all dead trees within twenty-five feet
of center of road, and shall keep
bushes, briars, etc. from the road to
it's full width.
Section 10. The contractor shall
keep all drifts from bridges, also shall
cut and remove any growth or other
kind of obstruction which may cause
filling of stream or decay of bridge
within twenty-five feet of all bridges.
Section 11. The contractor shall
construct dams or breakwaters where
needed and advised to do so by the
Supervisor.
Section 12. The contractor shall
grade an average of one hill to the
mile of road covered by his contract,
said hill to be selected by the Super
visor, cutting as much as two feet
from the top of a hill the crown of
which is not more than ten feet, the
dirt to be placed where directed by
the Supervisor, at a distance not
greater than two hundred feet; if the
hill chosen is more than ten feet on
crown and less than twenty feet, the
cut shall be one foot derp; if the hill
chosen is more than twenty feet the
cut shall be required made only on
one face or end of crown, and this
shall count as a hill. If the Super
visor shall not find each separate mile
to contain a hill which he deems it
necessary to cut, he may require an
equivalent amount of work upon an
other mile, the said grading to be lo
cated in each case by the Supervisor.
Where it becomes necessary to secure
a fair adjustment of this service the
depth of cut shall be altered to cover
the work. Any contractor desiring
to do so, may upon notifying his
Supervisor, obtain permission to do
all the grading required by this sec
tion in the first or the second years
of the contract.
Section 13. Roads in bottoms which
overflow may, if deemed best by the
Supervisor, be worked as follows:
All trees, stumps or other obstruct
ions shall be removed from the thirty
(30) foot right-of-way, and the same
shall be kept free from bushes, briars
etc., and the mudholes be filled with
small brush and dirt or gravel.
Section 14. The right is reserved
to the Board of Supervisors to with
draw from this contract at any time
any part of the roads, contracts for
which are entered into for macada
mizing or gravelling.
Section 15. The right is reserved
to the Board of Supervisors to with
draw from this contract any or all
roads in bottoms which may be over
flowed, but in no case less than a half
mile may be withdrawn.
Section 16. The right is reserved
to the Board of Supervisors to do
other work than that covered by
these specifications, at any place
chosen by them, the same to be done
by special contract or by the county
convicts, but not to interfere with or
injure the interests of the contractor.
Section 17. Wherever it may be
done without materiol cost to the
contractor the crooks in roads shall
be straightened, and no road shall be
made more crooked unless with the

consent of the Supervisor
Section 18. All work shall be done
under the supervision of the resident
Supervisor, or Road Commissioner,
should one be appointed.
Section 19. For purposes of pay
ment for the work outlined above,
the three-year contract is divided
into twelve periods of three months
each, near the end of which several
periods it shall be the duty of each
resident Supervisor or the Road Com
missioner to carefully inspect each
road in his district,, and to make a
written report to the next meeting of
the Board, stating the condition of
each link of road, and in case any
part of a link is out of repair or not
up to specifications, to make itemized
statement of work needed, and upon
these reports settlement for the pre
ceding quarter shall be made. No
Supervisor, however, shall be bound
to vote payment to the contractor
upon these reports if he know any
reason to not so do.
Section 20. At the end of the first
quarter, if it be found that all roads
are not up to specifications outlined,
but that a diligent effort has been
made to keep them in good repair
and to make progress on the width
and elevation, and as much as one
twelfth of them are in contract con
dition, then he shall be paid in full
for the quarter. At the end of the
second quarter the contractor is re
quired to have one-sixth of his roads
up to specifications and all the bal
ance in good repair, and for each
succeeding quarter a like proportion
shall be added to that up to plans
and specifications, in the meantime
keeping all parts in good repair, so
that at the end of the twelfth quarter,
or the end of the term hereby con
tracted for, all the roads shall be as
called for by these plans and speci
fications. In the selection of that
part of the roads to be first placed in
contract condition the contractor
may have the choice, but such parts
shall be worked in links or consecu
tive parts of links.
Section 21. The contractor shall
take over and work all roads here
after established upon the same terms
and work them in same manner as
the roads named in his contract.

on confirmation, with 10 per cent of
purchasers bid to be paid on day of
sale, the lands situated in DeSoto
county, Mississippi, described as fol
lows* to-wit:
The east half of Section three (3),
Township three (3), Range nine (9)
west, containing 320 acres, more or
less, and the south half of the south
east quarter of Section thirty-four
(34), Township two (2), Range nine
(9) west, containing 80 acres, more
