Laws in Regard to Municipal
El ('(lions Are Contradictory
and Will Cause Confusion.
JACKSON, MISS., April 24.—As re
cent acts of the legislature come
under legal scrutiny various glaring
errors are found which in some in
stances make the laws contradic
tory. Secretary Power was asked
to-day to verify the printed law in
regard to municipal elections. This
was House Bill No. 979 and under
took to amend the old law in re
gard to the tenure of municipal of
ficers. As the new law reads, elec
tions are to be held for municipal
officers in even years, "every two
years,” but the terms of office of all
municipal officers elected are fixed
at four years in the act.
In December next all municipali
ties, except where special charter
provisions provide differently, will
elect municipal officers in accord
ance with this new amendment. The
question is, which provision is to
control in the coming elections.
One lawyer has even raised the
point that under the four-year
clause, all present municipal officers
will hold for two years longer; but
as it is required by the law that an
election for new officers shall be
held this year, ti would be absurd
to contend that the law meant for
them to be elected two years before
they could qualify.
Another complication has arisen
as to the pay of the secretary of
the Railroad Commission. By an
error in copying, the law provides
that “the secretary of the Railroad
Commissioners” shall receive $2,250
per annum, and “the secretary of
the Railroad Commission" shall re
ceive SI,BOO per annum. There ha*
never boon such a position as “sec
retary of the Railroad Commission
ers,” hut the salary of the secre
tary of the commission has always
been fixed at a figure above SI,BOO.
