Be it ordained by the Mayor and Board of Aldermen of the city of Tu pelo, that Section 33 of an ordinance passed and approved by sa d Board,Oc tober 4th, 15)04, entitled “An Ordinance 1 Reguiating Sewers and Water Connec jtion and Plumbing,” which said Sec tion reads as follows: I ‘ Sec.ioa 38. Section 1. Be it ordained by the Mayor and Board of Aldermen of the city of Tupelo, that persons who haya no lights and shall install same in their premises, and those having lights and shall increase the number, or the can dle power, shall within • twenty-four hours thereafter, report the same in writing to the manager of the Light Plant, showing specifically the number of lights installed, the candle power of same; or increase in number, and can dle power of same, or the.increase in candle powar and the number of same so increased, and on failure so to do sh.il! toe subject to a fine of of not les s than §3.00, nor more than §25.00. in the discretion of the Mayor. Section 2. That for reasons satisfac tory to the Mayor and Board of Alder men, this ordinance shall go into effect from and after its passage. The above ordinance was reduced to writing before its adoption, and read over and considered section by section, and voted on section at a time, by yea gnd nay vote and was unanimously adop ted, all voting yea. Vardaman: YoUr petitioner, Dave Merritt, would respectfully show to your Excellency that he was convicted on the charge of murder at the August term, 1899, at the Circuit Court of Lee county. Miss., and sentenced to imprisonment for life in the State penitentiary; that there were mitigating circumstances in the killing of John Knox*; that there was no malice premeditated and the killing had in it the element of an accident, and your petitioner now feels that he has been sufficiently punished; that he has served the State faithfully during his confinement; that he has given the of ficials no trouble whatever and has tried to so conduct himsolf as to prove worthy of their respect and confidence. He now asks a pardon at the hand of your Excellency and in this his petition for pardon, he obligates himself to be come a law-abiding citizen if given his liberty. Dave Merritt.
