The case of the heirs of Silas Roberts against the Stilwell family camo up Friday before 'Squire Win get In the township rooms. The witnesses for plaintiffs were Samuel Ewlng, of Xenia. agent of the Roberts heirs, Mr. Foley, of Xenia, Henry Snyder and Mr. Adams. Xo defense was made, no one of the defendants appeared, although the Stilwells claim the farm belongs to them, that it was willed to them and that they have a title; but they have failed to produce any evidence ot ownership aside from the fact that they have occupied the place over 50 years and in that time have paid between S300 and S400 rent and no taxes. A Judgment was rendered for the plaintiffs, and there ap pears to be no alternative but for the Stilwell family to vacate.... There were ample grounds upon which I o base a motion tor dismissal ot this case, as, in reality, there were no defendants in the case. James Stilwell, one of the parties named in the suit has been judicially de clared Insane and is In the asylum. Samuel Stilwell, the only other male defendant Is admitted by the prosecution to be mentally in no better condition than James, and the balance of the family is said to be but lit tle.
