Liudsny, and incidentally throws a fow sidelights on tho Llano do Oro mine promotion, which proved a failure: One of tho largest suits that lias been filed in Cochise county for some timo, and involving in tho neighborhood of Mimo $300,000, was filed in the clerk's nrtico on Monday by Eugono S. Ivos, tho Tucson attomoy for tho plaintiff, Epo Randolph, of Southern Pacific fame. Tho defendants in tho caso nro Lyburgus Lindsay, r. C. Greono and tho Cananoa Central Copper company. The notion is brought ugninst Lindsay in articular, tho others being mudo par- tie to the suit so as to porfect tho caso against tho defendant Lindsay in oruor that the injunction could bo sorveu against them, thero being nothing at Usuo between tho defendant Greono nud the Cannnca Central company, only the service of tho injunction papers, so that Lindsay could not get the stock iuvolved from thorn. The caso involves tho question of titlo to somo 8,000 shares of tho Can anea Central stock that had boon sub scribed for by tho plaintiff Randolph from Greene, who had tho stock allot ted to him by tho Cananea Central Cop per company. Tho complaint alleges that tho com pany hns an authorized capital stock of ton million dollars, divided into one million shares at tho par vnluo of ton " dollars each. That prior to tho 10th day of August, 100(1, the company al lotted to tho defendant Greone somo 33,000 shares in such amounts as Greene might designate upon tho payment of tho first assessment of $3 each, tho bat nnco to bo paid when called for by tho company. That on the samo day tho de fendant Greono sold to tho plaintiff Randolph tho right to purchnso 10,000 of this stock. That on or about tho same day tho dofondnnt Lindsay agreed to denounce for tho benefit of himself and plaintiff certain mining property in the stato of Sonora, and would also turn over to this plaintiff cortain interests iu othor min ing properties ho had in Sonora in con sideration that this plaintiff turn ovor to said Lindsay tho right to subscribe to 3,000 shares of this stock that Ran dolph had socured the option on from Greene, and without further consider ation than tho promise of Lindsay, the plaintiff did turn over to him an order on Greone to dolivcr to said Lindsay ,,000 of the shares. That Lindsay, acting as agont for the plaintiff, and for himself, paid to the defendant Greene, for the benefit of the company, the sum of $50,000, boing tho ftrt payment of $3 per sharo on the stock. That about tho 18th of August tho plaintiff did sign and dolivcr to the defendant Lindsay an instrument which purported to assign to Lindsay tho right of this plaintiff to 3,000 ..shares and at the same timo paid to him tho sum of $10,000, thnt being $5 per sharo for the remaining 2,000 snares that the plaintiff was entitled to upon tho face of this transaction, and to which tho .plaintiff was entitled. Prior to the execution of this instrument the defendant, Lindsay, and plaintiff had been joint owners and promoters of tho Llano de Oro Mining & Milling company. That plaintiff be came interested in the property at the solicitation of tho defendant Lindsay, and by false representations to him in regard to tho property, and that ho and his friends put money in the enterprise to the extent of $300,000, mid that even that amount was not sufficient to put the property on a paying basis, and that thereafter plaintiff advanced mon ey to pay off tho indebtedness of tho company for labor, etc., and that Lindsay agreed to pay plaintiff hnlf of tho mon ey he had advanced in the proposition of the Llano property, and thnt when the plant was shut down in the month of November plaintiff advanced tho sum of $SO,000 to pay off the indebtedness of the company. That Lindsay now repudiates and disavows any obligation or intent on his part to pay back to plaintiff and of the money so advanced, and denies thnt plaintiff hns any right or title to any mining property that he (Lindsay) had denounced in Mexico, and by reason of tho said conduct on the part of tho defendant Lindsay he , has forfeited nny right to the 5,000 shares, or to even the 3,000 shnres that . ho had tho order for. That on tho 18th day of December tho plaintiff tendered to defendant Lindsay tho sum of $41,- 200, being the total amount paid by Lindsay to Greene, and interest thereon, less the $10,000 paid to Lindsay.by tho .plaintiff, and at the same timo notified ';him that nil agreements, etc., botwecn thorn were at an end, and that he, tho plaintiff, had tho solo right to secure or aubscribo for the remaining 8,000 shares of tho stock from Greone. That thoroaftor Lindsay tried to secure tho 3,000 shares from tho company by of fering tho sum of $80,000, boing the total subscription prico, and thnt plain tiff has also mado tho same offer, but that tho company refuses to issue tho stock on account of both parties claim ing it. Tho Southern Pacific has tho insldd track inasmuch as they havo secured concessions entitling thorn to tho ex clusive use to the right of way for ton years. The Pholps, Dodge interests, however, appear to hold the upper hand at tho town of Nacozari. Tho Southorn Pacific road tho Can nnca, Ynqni River & Pacific will have two lines paralleling eneh other. Be tween tho two linos will bo an impassi ble mountain barrier. These mountains have somo of tho richest mineral depos its known and the district extends from Nacozari to Alamos. Tho Phelps, Dodge people, who own the El Paso & Southwestern railroad, as well as tho branch to Nacozari, have recently been given a concession for a railroad from Guoymas eastward to the mineral district. Branches from the main lino which will likely ultimately reach Nacozari, will connect with Har mosillo, tho cnpital of Sonora, and with Ures, tho former cnpital. Speaking of the matter, tho Bisboe Review says, in part: This region is vast and in tho moun tains, hills and mesas, lying as dor mant ns it did ten thousand years ago, is mineral wealth enough to pay the debts of a hundred natious. In tho valleys and on the llanos aro rich agri cultural lands cnpable of supporting a vast multitude of people. Tho heart of Sonora is teeming with uncovered riches and it is tho prize the Ilarrimans and tho Phelps, Dodgo peoplo aro now stren uously seeking. Both know tho 'nlue of the region; both waut it. Who will get itf Tho Pholps, Dodgo people, controllers of tho El Paso & Southwestern system, formorly hold a federal concession of tho right of way for n railroad from the mouth of the Moctozuma river and other points, to Nacozari. This conces sion expired on Juno 30, 1900. The Southern Pacific people were on the alert and watchful. When tho conces sion expired, immediately Mr. McKay, tho Southern Pacific's right hand man, gobbled it for his company under the Mexican law, and thus the Ilarrimans obtained tho right of way north to Nacozari. They found tho Pholps, Dodgo people aslcop, and sharply took advautagc of thoir slumbers. But this docs not cad tho matter by any means. Tho Moctczuma Copper company holds largo mineral and other concessions from the stato of Sonora and these con cessions also give them the right to build and operate railroads. This con cession was granted by the stato of So nora to tho Mactczuma Copper com pany. Whilo tho Naoozari Railroad company has lost its rights from the Mexican government, tho Moctczuma Copper company still holds its rights from tho state of Sonora. Tho Phelps, Dodge people own and control the Na cazori Railroad company and the Moc tczuma Coppor company. The 5011I and body of one is the soul and body of tho other. Tho differenco is iu name only. The city of Nacozari, at the south end of the railroad, is owned by the Phelps, Dodgo folks absolutely, and James S. Douglas is the man in command. In and about Nncozari the Phelps, Dodge outfit own six square miles of land un der a paid concession. AVhilo they, to a certaiu extont, admit that tho South ern Pacific people now have tho right of way from Nacozari to Moctezumn, they most emphatically deny that they can lay track into Nacozari and operate aud maintain a railroad without cross ing and conflicting with their property interests. New York Times. PHOENIX MEAT TRUST CONVICTED BY JURY After deliberating two hours tho jury iu the so-called meat trust ease of S. J. Tribolet brought in a verdict of guil ty, says tho Phoenix Gazottc. Judge Edward Kent announced that sentence would bo passed on Saturday morning. A motion for a new trial will bo made and if that fails an appeal will be taken. Though United States Attorney Alex ander failed to even got the ice und lumber cases to the jury, he stated this morning thnt ho has no intention of iu any way giving up his efforts to secure convictions in all tho cases except those who havo gained immunity. "Tho next United States grand jury may bring in more indictments against local conspiracies in restraint of trade," said Attorney Alexander this morning, mentioning several who will bo investi gated when tho timo comes. At tho next term of court several cases which havo been postponed at this session will be taken up. BROKE INTO OFFICE OF YUMA SHERIFF Robbers broke into tho sheriff's ofiico at tho courthouso somo timo between 1 and 5 o'clock Tuesday morning and stolo six pairs of handcuffs, six guns and two cartridgo belts, says tho Yuma Sun. Tho thieves mado thoir entrance through tho south window of tho oflice, prying tho window open with a small iron rod about a foot long. Two guns and two cartridge belts woro taken from a cabinot that stands against the west side of the room, and tho othor four guns and tho handcuffs woro stolen from tho drawers or tho oflico desk, which stands near tho win dow. Nothing was disturbed in tho oflico with tho excoption of tho lock on cab inot, which was broken. Tho cartridge belts takon had never been used, and tho scabbards were also new.
