Dr. Charles U. Shopard, at his Pinehurst tea gardens, near Sunimerville, S. C, in connection with tho Bureau of Plant Industry, shows that 12,000 pounds of dry tea can bo raised on 100 acres. The foreign ten, it is said, often con tains indigo, Prussian blue, soapstone, turmeric, and leaves of plants other than tea, somo of which are harmful. PROPOSED FRANCHISE OF GLOBE CONSOLIDATED LIGHTING, WATER & POWER COMPANY An Ordinanco Granting to tho GLOBE CONSOLIDATED LIGHTING, WA TER & POWER COMPANY, Its Suc cessors and Assigns, tho Right to Con struct, Maintain and Operato a Water-works System, an Electric Light, Heat, Power and Gas System, in the City of Globe, Territory of Arizona. Bo it ordained by tho Mnyor and the Common Council of tho City of Globe, as follows: SECTION I. 1. That tho GLOBE CONSOLIDAT ED LIGHTING, WATER & POWER COMPANY, a corporation organized and existing under tho laws of tho Territory of Arizona, (hereinafter called tno company), its successors and as signs, is hereby granted and duly vested witn tno consont, permission, authority, right and franchiso to construct, or oth erwise acquire maintain, extend nnd operato within tho City of Globe, a water system, to supply tho said City of Globo and tho inhabitants thereof, with water to bo furnished by and tnrougn sam system; and tho said Com pany, its successors and assigns, arn hcroby granted for said purpose tho full right and authority to enter in and upon all streets, avenues, lanes, alleys, squares, plazas, publie parks and other public grounds and premises now or hereafter owned or controlled by said city, or which may bo horonffnr lni.l out or established within anv nnhnrlia or additions thereto, to take up pave ments anu siuowalks, and make such ex cavations as- may bo necessary, to lay, construct, extend, keep and jnaintain all tho necessary or ucedful mains, pipes, and connections necessary for said purposes, and to erect and construct its mains, pipes nnd conduits along and across all bridges and culverts in said City. 2. All work of taking up pavements and excavating in or uponjstroets, side walks, nvenucs, lanes, alloys, squares, plazas, public parks and other public places and grounds owned or controlled by tho said City, mado by tho Company or its successors or assigns, shall bo dono nnd performed in such manner as to cause tho least inconvenience to tho inhabitants of said City, and nil such places shall bo repaired and left in as good condition as beforo being dis till bed, nnd nil such work or interfer ence with tho streets or other public places shall bo dono or performed with all convenient speed by tho Company, its successors, assigns, agents and con tractors. 3. All such work shall bo done at tho cost and exponso of tho Company aud its successors and assigns, and it shall, without delay, remove all surplus soil, rock, rubbish, or other material, from such streets, curbs, alloys, public places or premises owned or controlled by tho said city, all of which shall bo at tho oxpense of snid Company, its successors and assigns. In the event that said streets, avenues, Junes, pave ments and Bidowniks bo not speedily re paired and replaced ns heroin provided, then tho said city may rcplaeo and re pair tho same and chargo the expense thereof to tho Company and its assigns, .vhich expenses may bo paid nnd col lected by tho said city out of r.ny sum or sums of money which may bo duo or become duo to tho Company nnd its suc cessors aud assigns under this ordin ance. . 4. Tho Company and its successors and assigns, in consideration of the grants in this ordinance mado and giv en, shall, by tho acceptance of this franchise, undertake, promiso and agree to furnish in tho said City of Globe, to tho City of Globe, and tho inhabit ants thereof ami to all the enterpriser herein using water, an ample supply of pure water (except in tho contingen cics hereinafter provided), for all nee essary purposes, that is, for domestic, sanitary, commercial, power, irrigatior or other uses, at prices and charge never to exceed those set forth, as fol lows: To ail consumers who do not usi tho meter Bystem for measuring the quantity of water used, tho Companj may make charges not to exceed the following: (p) Families of threo (3) or under . ... . $2.50 per month Families of four (4) to six (C).. ... $3.00 per month Families of'seven (7) or more . . ....... $4.00 per month Restaurants, to uso not to exceed seven thousand (7,000) gallons per months $3.00 per month Saloons . ....... . . $5.00 per month Lodging Houses, $3.00 to $4.00 per month Offices $1.00 per month Bathtubs, in barber shops or bath houses, for first tub $2.50 per month Bathtubs, in barber shops or bath houses, for each additional tub...-. . ......-.....!... $2.00 per month Bathtubs, for family use................ ....... .50 per month Flush closets for public use, for first closet $2.00 per month Flush closets for public use, for each additional closet .. .. $1.00 per month Flush closets for family use . .. ........... ......... .50 pep month Horse or cow . .50 per month (b) Or, in lieu of tho above rates, if meters shall have been installed foi measuring tho quantity of water, meter rates may bo charged never to exceed tho following: Tho Company may make a maximum chargo of threo ($3.00) dol lars per month, which shall entitle the consumer during such month to receive without further payment, threo thou sand (3,000) gallons of water; for each a-lditioiial ono thousand gallons above threo thousand (3,000) gallons per month, tho Company may chargo not to exceed fifty (50) cents per thousand (1,000) gallons; consumers using 100, 000 gallons or more per montn, shall pay thrrcfor at a rate not to exceed forty (10) cents per thousand (1,000) gallons; (c) Maid Company agrees to furnish, during the life of this ordinanco, water frco for .twenty (20) Double-discharge fire hydrants in tho City, and to furnish within tho city twenty (20) doublo dischargo firo hydrants, nine (9) of which arc to bo furnished at tho places where tho present double-discharge hy drants aro now located, and tho remain ing eleven (11) of said doublo-dischargo fire hydrants, tho said Company, at its own cost nnd expense, agrees to fur nish aud install within tho said city on any water mam not less than four (4) inches in diameter at sucli points as tho said City Council may designate; (d) For each additional double-discharge firo hydrant, nbovo twcnty(20), tho said City agrees to pay tho Com pany fifty ($50.00) dollars per annum for tho uso of water therefor, and for each single-discharge firo hydrant, the sum of twonty-fivo ($25.00) dollars per annum, all of which said additional firo hydrants, nro to bo placed and installed at tho exponso of tho said City and thereafter to remain tho property of said City; and tho water going through any of said firo hydrants, .or any other nro Hydrants liereatter to bo installed in said City and supplied with water by said Company, it to bo used only for tiro purposes, firo department drills and for tho testing of snid fiio hydrants. (o) Snid Company shall furnish wa ter frco for tho public building of tho City at all times during the continu ance of this franchise, but said water in said public buildings shall only bo used for tho necessary use within said buildings and for no other purpose; (f) All other water used by said City for its corporate use, for streot sprinkling nnd for flushing any sewer or cowers it may hereafter construct, shall bo furnishe'y tho Company nt a reasonablo rato:ttf,jbo fixed and deter mined by tlio;.Company ,nnd tho Com mon Council .qtiha safd City from timo to timo as the needs o' tho said City may require. " 5. All meters for .measuring water used cither by tlfo City or by private consumers shall b6 furnished by tho Company, its "successors or assigns, at its own expense, arid no charge for the rontal or uso of any such meters shall ovor bo made, and such motcra shall re main tho property of the Company. 0. For all tho purposes hereinbefore or hereinafter enumerated, said Com pany, its successors or assigns, shall fur nish an ample supply of water for do mestic and sanitary purposes, including tho sprinkling of lawns and other pur poses, to all consumers, at all times during tho continuance of this fran chiso; and this contract shall bo void ublo by tlie said City, upon the judg ment of a court of competent jurisdic tion, whenever thcro shall bo a substan tial failure of such supply, or a sub stantial failure on tho part of said Company to keop or perform any agree ment or contract on its part as herein specified; provided, that accidents, strikes, and railroad delays in shipment of supplies, fuol and machinery, or any other reasonablo delay, shall not be deemed such failure. 7. a dcubie-uischargo firo hydrants to bo furnished by tho Company to said City, shall bo standard firo hydrants with two two-and-ono-haif inch hose connections; and work on tho installa tion of said hydrants shall commence as soon as practicable after the appro val of this ordinance and tho designa tion by tho City of tho places for said hydrants, and such work shall bo prose cuted with duo diligence uutil complet ed within ono year after tho approval of this ordinanco and after tho designa tion by tho City Council of tho places whoro said firo hydrants nro to bo in stalled, unless tho said Company, its successors or assigns shall bo prevented therefrom by litigation, delay in the dolivory or manufacture of tho hy drants, or any parts or accessories thereto, or by other caure, without the fault of said Company, which shall ten der such completion impossible within said year, in any of which events the said term of ono year shall bo extended for so much time, nnd no more, as shall bo necessary to enable tho said Com pany by the uso of duo diligence to completo such installation. SECTION II. 1. Tho said GLOBE CONSOLIDAT ED LIGHTING, WATER & POWER COMPANY, hereinafter called the Com pnny, its successors and assigns, is here by granted tho right and franchise, and is hereby authorized to construct, or otherwise acquire, maintain, extend and operato, along, through, under, across and upon any and all of the streets, avenues, lanes, alleys .and other public places now in tho City of Globo or which may hereafter bo opened, cre ated, or acquired in or by said City, or in any futuro suburbs or additions to said city, poles, wires, cables and conduits, cither overhead or under ground, systems and attachments for tho transmission and distribution oi electricity nnd electric current, for light, heat, power, and all other pur poses for which it is adapted, and to carry on the business, or any part there of, of producing, transmitting, distrib uting, furnishing, supplying, renting nnd selling electricity, electric light, heat and power; provided, however, that all poles and wires shall be so placed as to cause as littlo obstruction of passage and traffic as may bo practicable, and the location of such poles and wires shall be subject to such reasonablo reg ulations as the said City by its Mayor and Common Council may from time to timo establish by ordinance. 2. Whenever excavations may be nec essary for the installation, extension and repair of said system or systems, tho Company, its successors or assigns, shall have the samo right to mako the same, subject to tho same restrictions and under the samo obligations as is hereinbefore granted for tho installa tion, extension and repair of its water works system. 3. Opposite P. o, J assigns, in consideration of tho fran chiso granted by tho preceding para graphs of this section, shall, by tho ac ceptance of said franchise, undertake, promiso nnd agree to furnish to the City of Globo nnd to tho inhabitants thereof electricity nnd electric current, for light and heat, at prices and charges never to exceed those herein set forth, as follows, to wit: (a) Said Company shall furnish to the City of Globe, frco of any cost or chargo to said City during tho life of this franchise, all tho necessary elec tric current and lights for tho proper lighting of tho public buildings of snid city; and upon tho said city agreeing to tako not less than (wenty street 1'ghts of tho kind hereinafter men tioned, tho said Company agrees "to in stall, at its own expense, a street light ing system, or circuit, of sufficient ca pacity for supplying twenty (20) or more arc lights in said city for street lighting; and said Company, its succcs sors and assigns, agrees, during tho con tinuance of this franchiser to furnish electric current to said city for said twenty (20) or moro arc lights (said lights to bo of uniform power), never to exceed tho prices and charges, as fol lows, to wit: Fivo (5) of said twenty (20) arc lights, frco of any chargo to said city; fifteen (15) of said twenty (20) arc lights, at tho rate of ten (10) conts per kilowatt hour; and any addi tional of said arc lights, required by said city, at tho rate of eight (8) cents per kilowatt hour; or, in lieu of the foregoing rates, tho said city shall have tho option of choosing flat rates, as fol lows, to wit: Fivo (5) of said twenty (26) arc lights, freo of any chargo to said city; fifteen (15) of feaid twenty (20) arc lights, at tho flat 'rate of one hundred and twenty ($12(.00) dollars per yenr per light; aud any additional of snid nrc lights, required by said citjl at tho flat rate of ninety ($90.00) do lars per year per light; provided, how ovor, that tho said city, immediately after tho installation of said streel Hzhting system nnd on or beforo tho first day of each and every year there-v after, shall exorcise its said option as to tho rates to bo paid to said Company for supplying electric current for said twenty (20) or more arc lights, and the during nights when there is no Moon light; (b) To tho inhabitants of said City of Globe, for light and heat, never to exceed tho prices and charges as fol lows, to wit: Consumers using per mouth an amount of electricity equal to ten (10) kilowatts or less, two ($2.00) dollars "per month; for each ad ditional kilowatt above ten (10) and not to exceed two hundred (200), fif teen (15) cents per kilowatt hour; for each additional kilowatt above two hun dred (200) and not to exceed four hun dred (400), twelve and one-half (12&) cents per kilowatt hour; for each addi tional kilowatt above four hundred (400), ten (10) cents per kilowatt hour. 4. Tho Company, during Hho life of this franchise, shall make and maintain all necessary connections with buildings and structures, in said City, for tho pur pose of supplying samo with electricity and electric current; and such connec tions shall bo mado nnd maintained by said Company regardless of whether tho electrical fixtures, lights and wires shall havo been previously supplied for, and placed in, such buildings or structures by said Company, or whether same shall havo been so supplied and placed by any other person, firm or corporation. SECTION III. 1. The said GLOBE CONSOLIDAT ED LIGHTING, WATER & POWER COMPANY", hereinafter called the Com pany, its successors and assigns, is here by granted the right and franchise, and is hereby Authorized to construct, or otherwise acquire, maintain, extend and operate, along, through, across, under and upon any nnd all of tho streets, avenues, lanes, alleys and other public pjuccs now in the city of Globe or which may hereafter be opened, created, or acquired in or by said city, or in any futuro suburbs or additions to said city, pipes, pipe-lines and conduits, systems and attachments for the transmission, distribution, productinn, supply, and use of gas for illuminating, heating and like purposes, obtained cither from natural sources or by any process of manufac ture, and to parry on the business, or any part thereof, of producing, trans mitting, distributing, furnishing, rent ing and selling gas; provided, however, that all pipes, pipe-lines and conduits for tho transmission and distribution of said gas, shall be so placed as to cause as little obstruction of passage and traffic as may bo practicable, and the location of such pipes, pipe-lines nnd conduits shall be subject to such reason ablo regulations as tho City by its Mayor and Common Council may from timo to time establish by ordinance. 2. Wherever excavations may'bc nec essary for the installation, extension and repair of said gas system or sys tems, the Companj, its successors or as signs, shall havo tho. same right to make same, subject to tho samo restrictions and under the samo obligations, as is horcmbeforo granted for tho installa tion, extension and repair of its water works system. 3. Tho Company, its successors nnd assigns, in consideration of -tho fran chiso granted by tho preceding para graphs of this section, shall, by tho ac ceptance of said franchise, undertake, promiso nnd agree to furnish to the City of Globe and to tho inhabitants thereof, gas for illuminating, heating or liko purposes, at prices and charges never to exceed those ns herein set forth, as follows, to wit: Consumers using threo thousand (3,000) feet per month or less, two ($2.00) dollars per thousand (1,000) feet; and any excess aboyo threo thousand (3,000) feet per month, ono dollar and fifty ($1.50) cents per thousand (1,000) feet. SECTION IV.
