"REBUKING" THE PRESIDENT.
Wo agree "with. EepresentaCive Pcrkin
that certain expressions used by Mr.
Hoosavelt In that part of his messago
relating to the secret service woro "un
fortunate"; so also was the legislation
therein criticised in language that has
ruffled the dignity of )the national leg
islature. The president could have been
more diplomatic in conveying his opin
ion of tho congressional limitation
placed on tho employment of tho secret
sarvico, hut that is not his way, and tho
result is a very pretty quarrel between
congress and tho executive, in which
tho necessities of tho public business
may receive scant consideration.
It is a serious thing for congress to
enter upon an attempt to censuro tho
executive, particularly in these days of
almost universal popular distrust of
legislative bodies. When It was dono
in Andrew Jackson's time, the presi
dent Anally won, though it took sev
eral years to make tho conquest, and In
tho end the resolution of censuro was
expunged from tho records. That a
trial of this v sort should bo in contem
plation agains a president of so great
apparent popularity attests the depth
of foellng which has been aroused
among members of congress. Yet they
aro, bat a curious freak of fortune,
turning upon a man who has saved
many of them from defeat, to whom
alone is due, in all probability, the ex
istence of a republican majority in tho
houso of representatives. They propose
to rebuke tho president who a few
years ago took tho part of congress
against tho muckrakcrs and who in
mora than ono election ha3 given tho
national legislature a certificate of
character that was worth votes to many
a distressed member.
The name of Roosevelt has been ono
to conjuro with in scores of closo dis
tricts; evidently it is so no longer. We
must assume that those who aro willing
to spread some sort of rebuke or cen
suro of tho president on the records of
tho houso and senate fcol that they
will bo able to justify their votes be
foro their constituencies; for after
March 4 Mr. Roosevelt will be merely
an eminent private citizen.
Wo doubt if the president intended
to asperse the character of tho avorago
senator or representative, or to insinu
ate that there wero any members of
tho present congress who will bear
watching by dotails from the secret ser
vice. Tho legislation he finds fault
with has seriously crippled tho ability
of tho government to detect and punish
fiduciary crime; it has ovon prevented
tho secretary of the treasury, as to se
cret 8orvico men, from exercising tho
ordinary right of overy head of a de
railment to control his own employes.
On these points Mr. Cortelyou's opin
ion Is tho same as that of the president.
In his righteous indignation over leg
islation that ho felt to bo advantage
ous only to criminals, tho president
dealt in implications that might better
have been omitted as a matter of com
ity in addressing congress. It may bo
questioned whether theso implications
are as serious as some members seem
disposed to think, or that any action
by congress reflecting on tho prosident
will really vindicate tho dignity of
either branch of tho national legislature.

need thorn. That is, tho man who can
afford to buy tho best in plenty should
bo given socks and gloves and such

But grown-ups don't make much dif
foronco one way or tho other at Christ
mas timo; tho day is tho day of tho
children.
Tho child who can have a now toy
almost any day in tho year is tho one
upon whom toys aro a wasto at Christ

now shoes, tho jackets, overcoats and
similar needful things.
But let tho useless things bo glvon
to thoso who havo but littlo moro than
necessaries all tho year around. Lot

of femlnino luxury, somo littlo useless
oxtravaganco that could not possibly

bo spared a "present" of something
that it actually needs and must havo.
What a ghastly perversion of the
spirit of Christmas it is to let tho child
shiver half through the winter so that
it may havo a "present" at Christmas
timo of a new coatl
Let the useful things be bought on
somo other day, but for Christmas itself
let tho pennies go for something which
has but one uso and that is to delight.
Let tho very uselqssncss of the gift, in
such cases, measure the love, the sacri
fice and tho Giving spirit of tho holi
day. In the Christmas spirit we recognize
that wo aro all children of the same
father and so aro all brothers and sis
ters and shall we givo the littlo broth
er of tho poor a pair of shoes and the
littlo brother of the Houso of Have a
coaster and his siter a big dolly?
No; however small tho gift, let's
havo it a real Christmas gift not a bit
of charity sneaked in on December 25
in order to save monoy and salvo our
souls with a doublo credit.

WASHINGTON, December 17.
President Rooscvolt today sent to con
gress a letter of tho secretary of war
transmitting memorandum prepared by
Judge Charlton of tho bureau of insu
lar affairH, and Richard It. Rogers, gen
eral counsel of tho Isthmian Cnnal com
mission, bearing further upon the
charges th.'jt Americans wero interested
in the Panama canal property at the
time o'f its purchase.
Tho memorandum states that at tho
time tho property was transferred to
tho United States it included so-called
"archives" and they are now in pos
session of this government. Examina
tion of these archives by Messrs. Charl
ton nnd Rogers show, however, that
neither at the time of tho first examina
tion or now woro thero any lists of
stockholders in tho old or nw Panama
Canal company oxcopt thoso contained
in tho formal minutes.
Burton Not To
Be Secretary
NEW TORY, Decembor 17. It wns
authoritatively stated tonight that the
offer of a cabinot position to Congress
man Thcodoro Burton has been with
drawn by Taft and will not bo renewed.
Burton has been mentioned as the
possible secretary of tho treasury and
it is said tho portfolio had been defi
ritoly offered him.
Tho statement 'follows a conference
by Taft with several of tho republican
leaders in Ohio. Burton, it is believed,
will now niako an activo contest in tho
Ohio senatorial campaign.
