ficer was at Uvalde, Texas, at noon
yesterday, having been delayed on tho
way. Uvaldo is about twenty-four
hours run cast of El Paso, and tho
Memphis mun cannot get to Globe be
fore tomorrow night.
If Rubcrto is released on habeas cor
pus proceedings today, the indications
aro that ho will at onco bo. turned over
to tho United States authorities and the
Memphis officer will have to wait quite
a whilo for his man.
NEW VIEW OF JAP

day morning before Judgo Norman J.
Johnson, the United States commission
er, on a chargo of using tho malls to
defraud, was plnced under $5000 bond
to appear for hearing Saturday after
noon at 3 o'clock. Failing to furnish
bond, tho Italian wus remanded to tho
county jail.
"Vox clamavis in deserto," (a voice
crying in tho desert), quoted Ruberto
in conversation with tho Silver Belt on
his return to tho sheriff's office
Ruberto had just como from tho oflico
of tho United States commissioner,
whero ho mado ono of his characteristic
speeches, exhibiting, by tho way, no lit
tle acquaintance with tho fcdoral postal
laws. Ho was in a philosophical mood,
nnd turning to tho roportor remon
strated gently:
"You have not treated mo fairly.
What will you say about mo tomorrow.
I can explain everything, but you nev
er guvo mo a chnncc. I know, it is al
ways so. When ono is in my position,
ono is vox clumnvis in deserto do you
know what that means?"
Ruberto was shown a enpias, or wnr
rant issued out of the criminal court
of Shelby county, Tennessee, together
with a letter from Sheriff F. S. Monto
verdo of thnt county, advising Sheriff
Thompson that A. 13. Hurst had been
deputized to como to Globo and tako
chargo- of tho prisoner. This was ac
companied by a letter from Chief of
Polico Georgo T. 0 'Haver of Memphis,
as follows:
"Memphis, Tenn., January 30, 1909.
"J. 11. Thompson, Globe, Ariz.
"Dear Sir I am sending a capias for
Alexander Kubcrti issued out of the
criminal court of Shelby county, in
which he stands indicted. Tho requisi
tion papers will be issued by Governor
Patterson on Monday and the officer
will start from Memphis, also, on Mon
day. Very truly yours,
"GEORGE T. O'HAVER,
"Chief of Police."
The crime, mentioned in tho capias is
forgery, and "instantcr" is written in
place of tho words, "the third Monday
in April," making tho document read,
"Tho criminal court will convene in
stantcr." .Also, tho word "again" is
written in over the injunction to the
sheriff, making it read, "You aro again
commanded to tako into custody tho
body of Alexander Kubcrti."
"What do 5'ou know about that?
What do they want you for?" the pris
oner was asked.
"Tbo samo thing as here," ho an
swered, after a moment of hesitation,
referring to tho two charges preferred
against him by local merchants, one of
which charges was dismissed by tho
district attorney whilo the other was
dismissed by Justico Hinson Thomas af
ter a hearing, as nlrendy published.
Whatever it may mean, Ruberto was
shockingly carelcs iu .his correspond
ence. "I do wish you would get out of thnt
business," it girl wrote to him. "You
havo a bad name hero. If you decido
to settle down nnywkern, I think you
would do well if you settle down un
der another name."
Other letters received by him from
men, apparently associates in business,
begin with, "Dear friend," and con
clude with "A friend," but tho anony
mous writers ceomed to bo writing in
the course of a regular correspondence,
for all thnt thoy studiously avoided
mentioning any names.
As anxious as ho was to return to
Now York in order to avoid being
taken back to Memphis, Ruberto had
already begun fighting his caso in the
metropolis and several telegrams wero
exchanged between him and tho Flor
ence Distilling company which he rep
resented on the road. From the. coun
ty jail, tho prisoner directed it certain
courso of action to bo taken by his New
York friends, but all this was cut short
tho instant he became a United States
prisoner. Postmaster Sturgls has put
a strict embargo on all telegrams and
letters, and Ruberto wns very much de
pressed in consoquenco.

opfum conference at Peking today was
tho attempt to pass tho Paino bill to
prohibit the importation and use of opi
um in this country for other than rae
dccinal purposes. Chairman Paine of
tho ways and means committee brought
up the bill. He explained thnt the mil
was druftod by Ex-Secrotnry J&ut, but
had been amended so as to permit tho
important of opium for medicinal pur
poses. The bill reduces the revenues
$900,000.
WOMEN GARDENIAS.
Unique Institution Started Abroad by
American Women.
Two American women nrc conduct
ing whnt Is described as "a village
Utopia" In England. One of them,
Mrs.. Victoria Woodbull Martin, has
enjoyed intermittent celebrity for a
good many years. The other is Mrs.
Martin's dnngbter, Mlw Znln Maud
Woodhull.
Tho village is near Norton Park, the
estate which Mrs. Martin luherlted
from her uccond husband several
years ngo. It Is called Brcdon's Nor
ton nud until recently was n "tumble
down, decaying agricultural village
managed In the old, inefficient style
and quite cut off from the outer
world."
The two Americans Improved the
village, had a fight with the education
authorities, which resulted In u com
plete reorganization of tho Bchool, and
finally restored the old manor house
and oiwried It as a woman's agricul
tural club.
A pamphlet describing the club and
Its objects give this outline of the
conditions of membership:
"Members staying at the club will
be able to tnke lessons In gardening,
dnlry or poultry work or bco keeping
for long or short periods.
"Members who have trained at any
of the existing colleges can live nt the
club and rent small plots, from half an
acre upward, which will enable them
to make n start in rriarkct gardening
with very little outlay.
"A horticultural school Is carried on
In connectlou with tho club. The
younger students, under the necessary
supervision, will live In separate bouses.
"Members may attend the higher
courses at Cheltenham Ladles' college.
"Members who live in the villtgc or
Immediate neighborhood may obtain
nil meals nt the club at u very moder
ate price. This Is an Important item,
as gentlewomen are oiien uuicrreu
from settling In the country on ac
count of the great difficulty of getting
nny ono to do the necessary cooking
and housework. By being able to ob
tain their meals they arc more or less

help."
The various fees charged tho club
members arc all moderate, says Town

cern of tho administration at this mo
ment to tho same extent ns arc certain
phases of tho anti-Japanese agitatiftn
in California.
Tho president has been in communica
tion with many persons who should
be thoroughly informed as to conditions
on tho Pacific coast.
It is admitted that systematic agita
tion has been in progress on tho coast,
but the significant feature of its lack
of strength was the fact, that tho labor
leaders have taken no prominent part
in it.
It oven has been stated to the admin
istration that tho mainspring of the ngi
tation was to be found in some of the
great corporations that had found their
profitable businefes of coolie transpor
tation threatened with destruction by
the success attending tho efforts of the
administration to stop this class of im
migration.
Tho fact is, that, in tho opinion of
tho administration, negotiations with
Japan for a virtually complete closure
of American ports to tho entry of Jap
anese laborers aro jeopardized by the
extreme utterances of certain persons
in California and by tho mere consid
eration of such resolutions as were en
tertained yesterday by tho Nevada leg
islatUrc. Even agreements already reached,
which are being carried out Jn good
faith by the Japanese government, are
regarded as endangered in the sense
that the present agitation might very
naturally tend to abate the interest of
the Japanese officials in the execution
of their obligations.
It is these considerations that have
influenced tho president to concludo
that everything posslblo should bo done
to prevent legislation by any state that
would discriminate against the Japa
nese as a class apart from other for
eign elements entering America.

vention is in session here to form a plan
for tho union of the colonies which have
been deadlocked for a week over tho
question of which city shall be tho cap
ital. A compromise is now being dis
cussed whereby Capo Town shall bo tho

istrative capital, and Bloomfontein tho
headquarters of tho judiciary.
