That whenever the C'ily Council shall deem It necessary to take private properly for Hie use of the City, and the amount of compensation due tho owner of such property cannot be agreed upon, the City Council thall, by resolu tion, state the particular properly sought to he taken, the nnmo of the owner, anil his residence (If known), which said res olution shall be 11 led with the City Clerk, who shnll Immediately notify the owner or agent or the property (If known) of the tiling of such statement. The original lease fur one year with the privilege of more was produced, and the question arose as to whether the holding over beyond the date or expira tion would hold for another.
