having been made upon them if served within
the State of Washington or 60 days if served
outside of the State of Washington or by publi
cation, to build, construct, alter or repair such
sidewalk upon said property described within
the said notice, then the Town Council shall
order the same to be built according to the
estimates on file with the Town Clerk, and
the cost of building thereof shall be charged
against the property, together with the costs
of serving said notice, which costs shall be the
same a* is lawful for sheriffs to charge in serv
ing civil process in the State of Washington,
and such costs of construction and costs of
serving shall become a lien against the said
property, and be collected in the same man
lier as tuxes are collected under laws of the
State of Washington.
Section 8. Said notice shall be served by the
Town Marshall or his deputies and liis return
nade thereon, and il the parties to whom said
notice shall be directed can not be found, or
are not residents of the State of Washington
he shull proceed to serve the same either by
personal service or by publication ot said
notice in the manner prescribed by the laws
of the State of Washington for the service of,
summons insofar an the same are not in con
ilict with or will not defeat the provisions of
litis ordinance.
Section 9. If within 10 days after the service J
is completed, the owner or owners of said pro- '
,<erty shall fail or refuse to construct same
according to specifications in the clerk's office,
then the same shall be built and constructed
•>y the street committee, or street superin
tendent, according to specifications and esti
mates thereof on file witli the town clerk, and
die cost of building, altering or repairing
lame shall be charged to the owner of the said
property, and be collected in the same manner
as other taxes are collected under the revenue
laws of the State of Washington.
Section lU. If the owner of the said property
shall at any time within the period mention
ed in the said notice, or within ten days
thereof, pay to the town clerk the sum esti
mated in tile said notice for the said improve
ment and pay tne costs of the service of tiie
-aid notice, then the clerk shall issue a receipt
therefor and such party shnll be exempt from
any further (barges or obligations, and the
street committee, or street oommissiouer shall
proceed to make the improvements the same us
the original owner thereof should have done.
Section 11. All persons who shall comply
with the provisions of the notice within fifteen
days after the same shall be served upon liim,
her or them, shall not be chargeable witli any
fees for the service upon them of said notice.
Section 12. This ordinance shall be in full
force and effect from and after the passage,
approval and publication thereof in the
official newspaper of the town of Kennewick.
