in each of the states
of Illinois and Nebraska has decided
that the provisions of the primary
laws of those states rei|iiiriug fees to
be paid by candidates who wish to
have tiieir names printed on the pri
mary ticket, are unconstitutional.
Based on these decisions, Attorney
general Fricli, of North Oakotu, has
rendered an opinion that the law of
this slate requiring a primary fee is
iievond the constitutional pale. Wliile
the attorii-y general's opinion is, of
course, not binding on county audit
ors. it is not likely thai any of these
officers will reluse to he governed by
that opinion. It may. therefore, lie
taken tor granted that no fee will he
:'Charged. Ilence.it would seem that
•••there can now lie no reasonable ob
jection by candidates ot' any parly to
ciiciilating a petition and getting on
the ticket in the regular way. rather
than by running by slickers, or by
holding ot! and having thu county

legislature was one by Senator Cashed,
democrat, which provided that the
candidates of a minority party should

paid candidates of the majority
