UAiejt, Plaintiff Attorney. EDITORIAL CORRESPONDENCE. Uiaiharck, Jan. 13,1909. Weil, the eleventh session of the legislative assembly of tbe state of North Dakota is now at work. So far, there hasn't been a single happening of a sensational order—scarcely enough excitement to keep the mem bership awake. The present session olds fair to be about the most har monious that has been held for sev eral years, although In legislative bodies something unforeseen Is liable to come up without warning that will cause for a time au exceeding liveli ness. The senate this year was organized in a thoroughly "angelic" manner— the former upper-house factionists eating from one another's hands as though that had been their habit for years. A committee was selected to distribute the loaves and fishes, and this usually herculean job was per formed in that manner which slang ists would term "dead easy." In the house there was a dead-lock of a day or two in the so-called pro gressive faction, the fight for success in tbe choice of speaker being be tween White of Traill and Skulason of Grand Forks. Mut a sufficient num ber to control tbe caucus could not be secured for either of the gentle men named, and a choice was flnally made of Usher L. Ilurdick of Cava lier, a young man who has not been closely Identified with either faction. Tbe opposing caucus settled upon George McCrea of Pembina as their candidate. It had been the wish of three-fourths of the members of both factions that the final choice of a re publican candidate for speaker should be made by a general party caucus composed of all the republicans of the bouse, and not, as was the case two years ago, by a part. \Vh«n the general caucus assem bled the test vote came on the mo tion to vote by ballot for candidates. This was lost "by 44 to 40—two mem bers not voting. Then, as is usually the case, a few went over to the stronger side and on the final ballot tor speaker, Mr. Burdick was declared the nominee of the united republicans by a vote of 48 to 38. Two men could not have been named tbe choice of either of whom for speaker would have provoked less antagonism than McCrea and Bur dick. The writer served with McCrea in the '05 session and with Burdick in the '07 session. Both were thor oughly Independent in the matter of legislation, and both were well liked by the fellow-members. Mr. Burdick. the speaker, is a man well equipped mentally and physically for the office. We say "physically" for the reason that the duties of the position entail much arduous work. Take, for In stance, the first week of the session The speaker is kept up day and night, almost, making up his committees. There is much pulling and hauling to secure places on the favorite commit tees, and by the time he has finished his strenuous job his ear drums are usually in bad shape and his legs a foot or so longer from the vigorous pulling of members. It is a job not often sought by a man beyond middle age, and it requires one who is able and willing to stand considerable hard physical and mental labor. The young speaker of the eleventh session is certainly competent to stand the fatigue, for he is about as perfect a specimen of young American man hood as one often sees. He is tall smooth-shaven, broad-shouldered and dark-complexioned. He was the youngest member ("the kid") of the 05 session, and 1 believe he is the youngest of the present membership. He is a noted athlete, being the same Usher L. Burdick who was a member of the victorious University of Minne sota football team of 1903. The speaker just finished making up his committees, although they have not yet been made public through the press. They will be an nounced today. The Kidder-Emmons members are assigned as follows: Tuttle—Federal relations (chair man.) Agriculture. Coal Lands and Mining. Warehouses, Grain Grading and Dealing. Joint Committee on Public Buildings. Streeter—Printing (chairman.) Ap portionment. Military Affairs. Edu cation. Supplies and Expenditures. Temperance. Joint Committee on Rules. As has been announced in the daily newspapers, Mr. Tuttle was given his certificate of election, which js signed by Governor Burke, Secretary of State Blalsdell and Attorney General Mc Cue. This thoroughly disposes of the contention made by the Herolz Storey people that the December eloc tlon was unnecessary and illegal. As a matter of fact it would have been necessary to hold the election if it was known that not a vote would be cast, and the auditors and sheriffs of the two counties would have been subject to penalty had they not done so. "The "Vontest'' ease of Storey- vs Herolz has been postponed until the 18th of this month. Attorneys Lauder and Engerud are watching the inter ests of Mr. Tuttle and Attorney Sor ley those of Mr. Storey in the matter It is a funny proposition. Storey con testa Herolz, who has no certificate of election—a proceeding unheard of heretofore. In the meantime Tuttle, chosen at an election held In absolute conformity with law. and at which Messrs. Herolz and Storey,-or either of them, had a right to run, holds the certificate of election, which is abso lute proof of the legality 0f tola choke seen a single attorney of any faction who does not believe that Tuttle is entitled to the seat. However, a par liamentary body is the sole judge of ihe qualifications of its own members, iind can unseat one of them for chew nu gum or anything else If It sees fit. nut it is not believed here in Bismarck that a factional majority of law-making body will use the strong jrm in violating tbe spirit of laws made by its predecessors. A vast batch of bills Is being pre sented. There are bills on every con ceivable subject—some members seeming to believe that they are working "by the piece" instead of by the day. A good share of the hard work of every session, on the floor and in 'committees, is in seeing that much of tbe proposed legislation does not pas*. It is too bad that some system cannot be thought out by which bills would have to be prepared and Kiunbitted by at least the 20 th of December to a state commission (or special 'court) composed of leading lawyers, who would pass upon the constitutionality of liills before they were presented, rather than have the supreme court tackle them after they became laws. But nf feasible plan along these lines has yet been formu lated I" any state. There is a strong feeling among senators and representatives in favor of good-roads legislation, and it likely that there may be some enact ments at this session that will radi cally change the present slip-shod methods of road-building. I saw Arthur Wescott a day or so ago. He says that Luther, his broth er, was, on December 9, operated up on for sail-stones, from which opera tion he died two days later.
