The court of ap peal* baa handed down a decision re versing the judgment of conviction of murder in the first degree uguiust him and granting him a new trial. Milburn of Buffalo uppeared for Molineux, arguing for n new trial. All the members of the court favor granting Molineux a new trial, the opinion being written by Judge Werner arid being about *25,000 words long. The gist of the findings of the court as stated in the opinion follows: "Every member of the court of ap peals agrees for the reversal of the Judgment of conviction of Molineux the groitu'd that the trial court erred in receiving in evidence the declara tions of Burnet, made to Drs. Phillips and Douglass, that he had received Kutnow powders through the mail.
