Tha Smith Embazzlamant Case.
The case of Attorney J. Ed Smith
charged with
brought to trial in Judge Molden's
court Tuesday afternoon and resulted
lo acquittal.
Dr. L. T. Mitchell was the comptai
ing witness. He alleged in his com
plaint that Smith had collected moneys
on accounts placed in his hands for col
lection and had failed to turn over the
same to him as directed.
Attorney Smith was represented by
Messrs Linger and Briggs, of Idaho
Palls and Phil. Averltt, of St. Anthony,
aud the prosecution was conducted by
Attorney Worth Clark in the absence
of the county attorney. A good jury
was impanelled and after the intro
duction of all testimony and arguments
by counsel the case was submitted and
the jury returned a verdict of "not
guilty."
This was one of those regretable cases
which often find their way into court. It
were better for all concerned and for
the community in which the differences
had their origin if the matter could
have been settled between Mitchell and
Smith, client smi attorney, without the
publicity it attained by trial in open
court.

A son of Charle* Chase about six or
seven years of age, shot his younger
sister with a revolver.
The little girl was looking in a trunk
for something, the boy saw the revolver,
ran and grabbed it and |minling it at
his sister said: "1 am going to shoot
you." The bail entered a Ur ill the cen
ter of the body and ranged downward
into the stomach. Dr. Hyde of Kexburg
was railed by telephone but he has no
hopes of her recovery as she is vomit
ing blood all the time. The accident
occurred at 2 o'clock last Mouday.—

Fire destroyed the barn, corral and
straw of Carl Macbold, a rancher living
on the Hopkins place, near the asylum,
Monday afternoon. But for timely as
