Attorney General Holds Dis tricts Must Insure With State Fund Unless Appli cation Denied. Ruling Given to Commis sioner of Education—If Turned Down Districts Furnish a Surety Bond or Guaranty Contract. This act shall apply to em ployes of the state and of all counties, cities, cities under special charter or commission form of government, vil lages, school^ districts, irrigation dis tricts, drainage districts, highway dis tricts, road districts and other public and municipal corporations within the state; but not to public officials who are elected by popular vote or who re ceive salaries exceeding $2400 a year. Policemen and firemen and others en titled to pensions shall be deemed em ployes within the meaning of this act. If, however, any policeman or fireman or other person entitled to a pension claims compensation under this act there shall be deducted from such com pensation any sum which such police man or fireman or other person may be entitled to receive from any pen sion or other benefit fund to which the state or municipal body may con t ribute. Jn his letter and opinion to the state commissioner of* education. Attorney General Walters says: "The question has arisen In numer ous instances ns # to whether or not the workmen's compensation act in cludes within its purview school dis tricts. and if so, whether such school districts must insure with the state insurance fund or have the option to submit 'a surety bond or guaranty contract.' WHAT LAW SAY8. "The workmen's compensation act reads, inter alia: " 'This act shall apply to employes of......school districts......and other public and municipal corporations within the state......' (1917 law's 255, sec. 2.) " A public corporation may insure against its liability for compensation with the state insurance fund and not with any other insurance carrier un less such fund shall refuse to accept the risk when the application for in surance is made.' (1917 laws 289, sec. 107.) CONCLUSIONS REACHED. "From the foregoing provisions it appears that: "1. School districts are within the purview of the act; and, "2. That such districts must insure with the state Insurance fund unless their application for insurance therein is denied, in which last Instance, only, may school districts furnish a 'surety bond or guaranty contract.'" In 1915, when Miss Kane, who Is ap pearing' in a new Mutual-American production, "The Upper Crust," bought the place, there were fifteen regular •happed and spurred cowmen employed in riding the range, branding and gen eral round-up work, but today the only ; man on the ranch Is Michael St. Cyr, a half-breed Frenchman, while young women hands are doing the work that formerly was considered fit only for male employes. Bight of the cowmen formerly on the j«>b are In France, herding Boches along the Aisne front, five are in train ing camps, getting ready for service, and two are cattle buyers for the gov ernment. The cowgirls, who are all fine horse women, draw regular pay for their work, which has proved highly effi cient. Miss Kane's reports from the ranch show that there has been no de predation in tiie value of the property because of the strange innovation, and she is thinking seriously of making it permanent.
