Commissioners' Proceedings Silver City, Idaho, Thursday, November Utb, 1909. The Board of County Commissioners of Owyhee County, Idaho, met in special session at the office of the Clerk thereof, in Silver City, the county seat of said county, on Thursday, November 11th, 1909, for the purpose of taking action upon such applications for Liq uor Dealers' licenses as may be pre sented to the Board. Also for the consideration of, and taking action upon the petition of A.R. Irwin, L. B. Cowan, R. S. Estes and others for the laying out of a new road from the N. W. corner of Sec. 9, T. 3N., It. 5VV., to the Oregon line, and iug the bond to be submitted in ueciiou with said petitiun. Also for the purpose of taking action upon such petitions as may be present ed for the appointment of a Constable and Justices of the Peace for Kings Hili Precinct. Also for the purpose ol taking action upon the resignation of A. L. McKeeth, Overseer of Hoad District No. 9, aud taking action upon such petitions as may be presented for the appointment of an overseer of Road District No. 9, Also for the purpose of taking such action as may be deemed necessary to provide offices, aud suitable furniture for tbe same, for the county treasurer and prosecutiug attorney, either through purchase or lease of such prop erty as may be necessary for that pur pose. Also for the purpose of receiving the -report of 8. A. McAnulty, Frank Byron Smith and Charles W. Fuller, hereto fore appointed aB viewers of a proposed road over aud across lauds included iu that certain tract of laud commonly known as the King Hill Segregation, aud fixing a day for hearing said report. Present: C. H. Grete, Chairman, J. Harley, Commissioner, and J. S. St Clair, Clerk. The following proceedings were had, to-wit: Whereupon, the Board examined and duly approved the application of Hodge Bros., for a License to sell intox icating liquors in Brnneau Precinct, aud ordered a license issued to said firm for the period of twelve months commencing on the first day of Novem ber, 1909, and expiring on the 31st day of October, 1910. In the Matter of the Petition of A. R. Irwin, L. B. Cowan, R. S. Estes and others for the laying out, con struction and establishing of a public road briefly described as rnnning from the town of Homedale, in Owyhee County, Idaho, in a Northwesterly direction to the Oregon State line : It appearing to the satisfaction of the Board that said petition sets forth and describes particularly the road to be constructed, and the general route thereof, over what lands, and who the owners thereof are, whether the owners consent thereto, the necessity for and the advantage thereof, and that said pe tition is accompanied by a good and sufficient bond, in the sum of 8200.00, being double the probable cost of the viewing ahd laying out of said road with Hugh Lee and Raymond S. Estes as sureties thereon, conditioned that \ the bondsmen will pay all the costs of viewing and surveying in case the pray er of said petition is not granted, and the road finally not opened, which bond, in the opinion of the Board, is a good aud sufficient bond for that pur pose, It is therefore ordered that said bond be and the same is hereby approved, and that Chas. H. Grete, Chairman of the Board, be and he is hereby au thorized to approve said bond for and on behalf of Owyhee County, in the State of Idaho, by its Board of County Commissioners. It is further ordered that Fred H. McConnell, J. G. Tracy and R. A. McDowell be and they are hereby ap pointed as viewers, to view and survey approv eon ' A. said proposed new road, in accordance with the description in said petition, and submit to the board an estimate of tbe cost of opening said road, including purchase of the right of way, and tbeir views of the necessity thereof, 1° the matter of the petition of C. E. Bott, A. P. Carnahan, Chas. C. Smith and others asking for the appointment °f B. C. Michaels as Justice of the Peace, and William Westfall, as Con stable of the King Hill election pre oiqpt: Whereupon, it appearing to the satis faction of the Board that said offices are vacant, and that said petition is signed by not less than fifteen of the qualified electors of said precinct, It is therefore ordered that said pe tition be and the same is hereby grant ed, and that said R. C. Micheals he ap pointed an Justice of the Peace, and William Westfall, ss Constable, of said King Hill precinct, to fill the vacancies existing in said offices, li is further ordered that the said R. C. Micheals be appointed as Justice of the Peace, and William Westfall, as Constable, of said King Hill precinct, to Blithe vacancies existing in said offices. It is further ordered that the said R. C Micheals and William Westfall be qualified as Justice of the Peace and Constable, respectively, of said King Hill Precinct, upon each furnishing a bond in the sum of 8600.00, to be ap proved by the Board of County Com missioners. Whereupon, is it ordered that the resignation of A. L. McKeeth, as Road Overseer of Road District No. 0, of Owyhee County, Idaho, be and the same is hereby accepted, and the sure ties on his bond as such Road Overseer be relieved from all further liability thereon. ' Whereupon, it is ordered that the pe tition of James Garbutt, Jens Jensen, N. G. Massey and others, asking for the appointment of Ross McKeeth, as Overseer of said district, to fill the va cancy created in the office of Road Overseer of Road Distriot No. 9, by reason of the resignation of Baid A. L. McKeeth be aud the same is hereby granted, And it is farther ordered that the said Ross McKeeth furnish a good and sufficient bond in the sum of 8300.00, in favor of the county, to be approved by the Board of County Commissioners. Whereupon, it is ordered that this Board do now adjourn until Friday, the 12th inst., at ten o'clock a. m. Attest : C- H. Grete, chairman. J. S. St Clair, Clerk. Fuller, heretofore ap pointed as viewers of a proposed road over and across lands included in that certain tract of land commonly known as the King Hill segregation: Whereupon, the report of said view ers being now on file with the clerk of the Board, It is ordered that tbe same be re ceived, And it is further ordered that said report be set for hearing on Thursday, the 13th day of January, 1910, at 10 o'clock A.
