The Police Jury met in regular ses sion this first day of -December, 1913, with the following members present: Mr. J. T. St. Cyr, President pro tem, I1 presiding; Messrs. Durio, Dimmick, Guillory, Dailey, Isekinghausen, Pavy, Dunbar, Brown, Walters, Beall, Mc Caffery, Foster. Motion by Dr. Pavy Be it resolved that a committee of 1 three fromn this body be appointed to draft resolutions on the death of Dr. W. F. Clopton, President of the Police Jury, and Resolved further, that the Police Jury now stands adjourned until 1:30 o'clock p. m., in respect to the memory of our deceased President, Chair appointed Dr. Pavy and Messrs. Dimmick and Beall. EVENING SESSION. The Police Jury met pursuant to ad journment. Present: Mr. J. T. St. Cyr, President pro tern presiding; and Messrs. Durio, 1 Dimmick, Guillory, Dailey, Isering-- 1 hausen, Pavy, Dunbar, Walters, Beall, McCaffery, Foster, Brown. The following preamble and resolu tion was offered by the committee ap pointed for said purpose, and was adopted unanimously, to-wit: Whereas, the Great Ruler of the Universe, in his all wise providence, has seen fit to call from this life the Honorable W. F. Clopton, President of this body; and whereas, his passing away to the life beyond the grave is a distinct loss to. this parish, and the members of this body; and whereas, the deceased served his country with a strict adherence to duty seldom equalled and never surpassed, there fore, Be it resolved, That this body in its sincere sorrow extends its condolence and sympathy to his bereaved fazpily and Recolved further, that a copy of this resolution be spread upon the minutes and one sent to the family. Be it further resolved that this reso lution be inserted in the St. Landry Clarion and the New Orleans Times Democrat. (Signed) F.O. PAVY FRANK DI kMICK, W. C. BEALL, Committee. Mr. McCaffery moved that the Police Jury now proceed to the eleetion of a President. Motion carried. Dr. Pavy placed in nomination, Mr. Frank Dimmick, seconded by Mr. Mc Caffery. Mr. Guillory placed it nomination Mr. J. E. Dailey, seconded by Mr. Isering hausen. On motion of Dr. Pavy the nomina tions were closed. Mr. Dimmick received 8 votes and Mr. Dailey 4 votes. Mr. Dimmick receiving a majority vote cast, upon motion of Mr. Guillory, Mr. Dimmick, was declared elected un animously. Mr. Dimmick assumed the chair as President. Received from Mr. Thomas McCaffety the sum of nineteen and 50-100 dollars realized from the sale of old lumber, 5th ward. " On motion of Mr. Guillory duly sect onded and carried Dr. P. Foster was elected a member of the Parish Board of Health vice Mr. F. Dimmick. Motion by Mr. Brown The report of committee on insurance of the Courthouse annex tothe effectthat said insurance was placed for an amount of $5,000.00 for five years at a total cost of $135.00 be and the same is hereby accepted and committee dis charged. Motion carried. Motion by Mr. Guillory That the sum of eighty cents be re funded to Alfred Frilot, as the said amount was paid through erroneous assessment year 1913. Motion carried. The following License Ordinance was offered by Mr. McCaffery seconded by Mr. St. Cyr. LICENSE ORDINANCE. An ordinance for the levying and collecting of Parish Licenses for the year 1914; Be it ordained by the Police Jury of the Parish of St. Landry in regular ses sion convened: Section 1. That the license laws of the State of Louisiana now in force shall in so far as applicable be the li cense ordinance of the Parish of St. Landry for the year 1914, except as hereinafter modified and changed; Section 2. That the annual license for peddlers and hawkers in one and two horse vehicles shall be $15.00 and $20.00 respectively; Section 3. That th'e amount to be paid as an annual license tax by retail dealers in distilled, alcoholic and malt liquors shall be giaded as follows: First Class: When the gross annual sales shall be $30,000.00 or more, the licence shall be $2,500.00; Second Class; When the gross an nual sales shall be less than $30,000.00 and not more than $20,000.00 the license shall be $2,000.00; Third Class: When the gross annual sales shall be less than $20,000.00 and not more than $10,000.00, the license shall be $1,500.00; Fourth Class: When the gross an nual sales shall be $10,000.00 or less the license shall be $800.00; Section 4. That this ordinance shall take effect on and after January 1st, i 1914. Adopted December 1st, 1913. FRANK DIMMICK, President. Attest: J. J. HEALEY, Clerk. The following ordinance was offered by Mr. McCaffery, and upon being duly read was adopted unanimously, to-wit; I ANNUAL TAX ORDINANCE. Whereas by resolution adopted on I October 6th, 1913, this body framed a budget of Ninety Thousand Two Hun dred and Sixty-seven and92-100Dollars, ($90,267.92); as an estimate exhibiting the various items of expenditure that i the parish of St. Landry would require I for the year of 1914, and Whereas, said budget has been pub lished in the St. Landry Clarion, the I official newspaper of this parish, for the full term of thirty (30) days as the law I directs, and Whereas, an ad valorem tax of ten (10) mills on the dollar of the taxable property of this parish will be reqnired in addition to the revenues to be deriv ed under the license ordinance adopted 1 to meet said budget: Now thorefore, be it-ordained by the I Police Jury of the Parish of St. Landry, that a tax of ten (10) mills on the dol- 1 lar be leviwd on all taxable property 1 situated wifhin this parish on which the State levies a tax, to meet said budget of expenditures for the year 1914. Brown- Resolved, First: That the President I of this body be and he is hereby direct ed and instructed to appoint from among the members of this body a committee i of three to advertise for sealed bids from the banks located in this parish to act as Fiscal Agent of this parish for the two years beginning on the 2nd day of Feb. 1914. Second: That all bidders must make their bids in conformity with the pro visions of Act 316 of the act of the General Assembly of this state for the , year 1910, and be required to state I separately and distinctly, first, what rate of interest they are willing to allow to the parish for such sums as it may have on deposit during the existence of 1 the contract, and, secondly, what rate i of interest they propose to charge the parish for such loans or advances as ma be required to meet its annual budget appropriations in anticipation and in advance of the collection of its annual revenues; .Third: That all bids must be ad dressed to the "Police Jury of the Par ish of St. Landry," and must have legibly written or typewritten on the outside of the envelope and on the same side as the address, the words "Fiscal Agency Bid," and that all bids must be delivered at Opelousas. La., to the Clerk or some member of this com mittee on or before twelve o'clock noon, on Monday, January 5th, 1914, :.t which time they will be opened and the fiscal agent designated and the amount of its bond fixedby this body. On motion of Mr. Dunbar The Police Jury adjourned until to morrow morning at 9:30 o'clock. December 2nd, 1913. The Police Jury met pursuant to ad journment. Present: F. Dimmi'k, President; Messrs. St. Cyr Dailey, Iseringhausen, Pavy, Brown, Walters, Beall, McCaffery Gournay, Durio, Guillory, Fisette. Dr. Pavy offered the following reso lution: Whereas, it is the sense of this body that it has the right under the Gay Shattuck Law to regulate the licensing of saloons in the parish of St. Landry, and Whereas, the parikh -of Evangeline has voted to exclude the sale of liquors in every ward save one, and Whereas, it is the purpose of this body that the ordinance of our sister parish of Evangeline excluding the sale of liquors therefrom, should be given full force and effect as far as it in our power lies. Therefore, Be it resolved by the Police Jury of the parish of St. Landry in regular session, that no permit be granted to any person or persons, wish mg to carry on the saloon business for the sale of liquors within five miles of the division lines, between the parishes of St. Landry and Evangeline. Be it further resolved that this resolu tion is not to affect any person or per Ssons already established and doing business during the year 1913. Dr. Pavy called for the yeas and nays, 1 Messrs. Dimmick, Dailey, Pavy, Wal tters, Beall, McCaffery, and Gournay voting yes, 8 yeas. Messrs. Isering I hausen and W. F. Brown voting no, 2 nays. Motion carried. Motion by Mr. Beall Be it resolved by the Police Jury of i the parish of St. Landry in regular ses sion convened, That notice is hereby given to all persons now or hereafter I conducting saloons for the sale of liquor I in the parish of gt. Landry, that said Ssaloon business must be conducted and operated in the manner prescribed by Sthe Gay-Shattuck Law; and Be it further resolved that the Sheriff of the parish of St Landry is hereby earnestly requested to see to it that the I law is complied with, and he is further requested whenever any violation of A said law is discovered, to report the same to the proper authorities for A *prosecution; also to make a report of said violation to this body; and A Be it further resolved, that if it be in power of this body to cancel the permit f granted any one for sale of liquors, it will do so in the event any one is re- C ported for having violated any of the provisions of the -ay-Shattuck Law. J Motion by Mr. Gournay That the Clerk of the Police Jury be I instructed to notify the officials of the I Rock Island Railroad to repair the grade \ at their crossings over the public roads of this parish especially the second public road crossing north of Eunice, in accordance with the ordinance of this ( Police Jury regulating same. Motion carried. Motion by Mr. Gournay Be it resolved that a committee com psed of Messrs. Francois Savoy, Ran Young, Marius McGee, Plenny Prud homme, Louis Courville,* Durel Aguil lard and Adam Fuselier, be appointed to lay out a public road as per petition on file beginning at the east corporation line of the town of Eunice on the line between sections 30 and 31 of Township 6 S. R. 1 East and running east on said section line and continued between sections 29 and 32 and between sections I 28 and 33, and between sections 27 and 34 and continuing on due east to the I intersection of the public road leading from Evangeline parish to Prudhomme City, a total distance of about three and a half miles; resolved further that the I said committee be directed to lay out an intersecting road to the above begin ning at a point at or near the southwest corner of section 27 in township 6, S. R. 1 east, on road above petitioned for, and running north along or near the west boundary line of said section 27 to a convenient point north of the N. O. Texas and Mexico R. R. right of way, thencer east or in an easterly direction to the intersection of said public road leading from Evangeline parish to 1 Prudhomme City, a total distance of about 2 miles; be it further resolved that the Road Superintendent be instructed to survey said roads withthe committee in accordance with the ordinance of this body. Motion carried. Motion by Dr. Pavy Whereas, athe American pedple in geheral have awakened to a realization of the fact that the United States Gov ernment should, under some broad and comprehensive scheme, undertake to protect the valley of the Mississippi River and its tributaries from the an nual overflows which devastate the ad jacent lands and impoverish the inhabi tants; and Whereas, the Congress of the United States seems to be responsive to the de mands of the people in this particular; and Whereas, a large section of this par ish is annually affected to a serious ex tent by these recurring floods; and Whereas, a bill known as the New land Bill, is now pending in the Con gress of the United States, embracing, as we believe, the provisions -necessary for the United States Government to ef fectively guard the aforesaid affected areas against these devastating floods; Be it resolved, that we, the members of the Police Jury of the Parish of St. Landry do hereby approve the said Newland Bill and most heartily endorse the action of those representatives in Congress from this State in supporting and advocating the same; and we do most earnestly urge those representa tives who have not done so, not to further hinder the passage of the said Bill. Be it further resolved. that the Clerk of this Body be, and he is hereby in structed to furnish copies of this resolu tion to the New Orleans Press, as also to each member of the Congressional Delegation from Louisiana. Motion carried. Opelousas, La., Dec. 2, 1913. To the Honorable President and Members of the Police Jury, Gentlemen: We, the undersigned committee appointed to examine the statement of the St. Landry State Bank, fiscal agent, beg leave to report that we have examined said statement and found same correct and recommend that a warrrant for the sum of three -hundred and thirty-nine and 47-100 Sdoelars ($339.47), be issued to said fiscal Sagent for salary interest month of Nov. . 1913; interest deducted on deposits as per contract. Dr. Pavy moved to table Mr. Dailey's I motion. Messrs. Dimmick, Pavy, Fisette, Walters; Foster, voting yes, 5 yeas. Messrs. Guillory Dailey, Isering hausen, Brown, MeCaffery, voting no, I 5 nays. A tie vote resulting, the original mo tion stands adopted. Motion by Mr. Dailey That the applications of the following I named persons praying for permits or licenses to coPduct saloons in the locali ties mentioned in their respective peti tions, be received and granted as pray ed for andthat the sheriff and ex-officio Tax Collector be and he is hereby authorized to issue licenses to the fol lowing persons for the year 1914, to-wit: Henry English, a saloon forwhites on public road near Bayou Jack in what is known as the Fred Robinson building. A. B. Bordelon, a saloon for colored people on public road about half way between Big Cane and Godeau, La., in what is known as the Godeau build ing. Motion carried. S. c Brown, the following resolution was adopted: Be it resolved, That a vote of ' r thanks of this company be and is hereby extended to the Mayor and Board of Aldermen for their 5 action in nontracting for a fire alarm, and in our opinion, the best on the market. SIt is a fact that we are prac - tically without a fire alarm since 8 the power house whistle is out of service, and it is only through -courtesy of the Cumberland Tel- i o ephone Company that informa- c -tionasto the whereabouts of at s fire can be obtained. The result I is that valuable time is lost. By I installing this system it is a step d forward towards placing our city - in Class "B" thereby reducingI the insurance rates. With an up to date, reliable a fire alarm system many valuable Sminutes will be saved in reach I ing and fightingfires; which not ,- only means to the public a more 3, efioient service, but dollars . saved, not to mention that Ope re lonsas is keeping pace with the times. Providing for the levying ~xf license tax upon all associations of persons, a or corporations, conduct h business of retail liquor ers within the corporate of the City of Opelousa,: for the year 1914, same, and providing' penl for the violation hereof. Seetion 1. Be it ordained b the Mayor and Board of Alder men of the City of Opelous La., That there shall be, an there is hereby levied u on al persons, firms, corpo o association of persons, in the business of retail dealers for the year 191 following license to-wit: Class 'A." When the. annual receipts of said bu.s shall be one hundred th dollars and over seven thousand dollars, the ann licenser shall be three thou dollars. Class "B." When the annual receipts are seventy thousand dollars or. more forty thousand dollars, the .a nual license shall be two th. sand dollars. Class "C." When the annual receipts are less forty thousand dollars, the nual license shall be eight hin dred dollars' provided that license shall Le issued under t ordinance for less than eg hundred dollars, except as vided for by existing state law to dealers in mault and 'vii liquors, Section 2.
