The subjoined extract friom the imesl-Democrat is an opinion de livered by Alex Del Mar of New - York, writer and authority of some note on fliiancial questions. As it S relates to a point much discussed, tIhe we reproduce it for thebenefit of our pa: readers. bMr. Del Mar says:: Your editorial of July 30,-"Gold Bonds and Contracts," reached me through a newspaper clipping agen cy. The question as to wlhether a corporation or individut 1 cai can tract himselfout of the law of money as, hiti down iwtihe civil law, name ly. that "that .is money which the State declares to be money" (vide .Paulus, as ciued in the digest,) was never so ably nor so exhaustively t argued us in, the celebrated case of the "Mixed Moneys," in 1604, which was decided by the Privy Council of Ireland. This decision expresses to-day the law not only of England, but, also thlat of every State which owes its origin to ,Rome, including, of course, the United States of America. The case is fully report ed in Davis' Reports, London, 1674; i also in State 'Trials, vol. II, page, t, 114, ed..1809. A very lull summary y will be found in my "Semence of A Money," second edition, 1896, page 95. The gist of the decision was that all contracts for money arc t dischargeable in any money which is current or legal tender on the day and at the place of paiynuent. To Y overthrow this decision it would be Y ,necessary to lupset. the most cele y brated jurisconsults of all the ages, including Paiulus, Bodin, Budelius, lMolhiaeus, Baldus, etc. I am of d opiniolt that contracts specifically Il payable in at particuhlar .sort of lloney, evetn though .such contracts , are authorized by an. act of Coii S, gress, are ultra vires, .and will not r. be sustained by the courts of last u- resort. Their .enflorcemelnt would e- destroy that necessary prerogative of sovereignty which ettables the a- State to create money and regulate its volume and denomunatioxns. Agents' ,Harvest Time.
