sonhas wholly failed to build a habitable
dwelling upon said tract, or reside thereon
that he has failed to break or cultivate, or

contestant, against William M. Smith, home

William M. Smith has wholly abandoned
said tract and that he has neither built a
house or shanty thereon or caused the same
to be built: that he has wholly failed to

that he has not resided thereon from the
date of his filing to the present time, and
that the land is in a state of nature, and that
