Notice is 'hereby given that by vir
tue of a. special execution issued out
of the office of tile Clerk of the Dis
trict Court, in and for Ward County,
North Dakota, to me directed and de
livered, and now in my hands which
said special execution was issued and
delivered to me, as aforesaid, on the
5th day of July, 1910 and was based
upon a certain judgment and decree,
rendered in the above entitled action
docketed in Ward county North Da
kota, on the 20th day of June, 1910,
wherein it was adjudged and decreed
that the plaintiff to (have and recover
of the defendant, Ira Pellett, the sum
of $179.65 and wherein it was fudther
adjudged and decreed that said judg
ment constituted a valid and subsist
ing lien upon the following described
land in Ward county North Dakota, to
Commencing at the southeast (SE.)
corner of Section twenty-eight (28) in
Township one hundred sixty-one (161)
North of Range Eighty-six (86) west
of the 5th Principal Meridian, same
being at the point of beginning, thence
due north 12 1-2 rods, thence the west
at right angles 13 rods, thence due
south at right angles 12 1-2 rods to
the section line thence along said
line due east 13 rods to the
place of beginning. And wherein it
was further adjudged and decreed that
said, premises be sold by or under the
direction of the sheriff of Ward coun
ty, North Dakota, for the purpose of
satisfying and paying the said Judg

A SMALL FIRE
A match carelessly thrown in a
waste paper basket at the Grill this
afternoon created some excitement
for a few minutes. The flaming
basket was carried outside where the
fire could do no danger.
J. B. Tracy is able to walk about
on crutches. Several weeks ago,
while dragging his land, the drag
struck a huge boulder and Tracy was
thrown to one side just in time to
get his foot caught under the boulder
which was partially pulled out of the
hole. The bone of his leg just above
the ankle was broken and for nearly
an hoajr he was pinned to the ground
by the stone.
Commissioner Emerson is fishing at
the lakes near Brainerd, Minn.

A well to do Sawyer farmer named
Wassel, is a fugitive from Justice.
He is charged with resisting arrest,
and assaulting the officer Constable
Fisher, who attempted to place Mm
under arrest Wednesday morning,
charged with shooting ducks out of
Two deputy game wardens, Jack
Lacoduck and Fred Waldrlck, have
been after Wassel for several uays.
A warrant was sworn out for the man
and the officer saw him come out of
his house Wednesday morning with
five companions. When he read the
warrant, the man resisted arrest and
Fisher was attacked by- the party and
his eyes blackened. One of his as
sailants has been arrested and will
be given a hearing July 16.

of the city, struck a flowing well.
The waiter comes thru a one inch
pipe at the rate of eighty barrels a

have struck good flowing wells at
about the same depth. It seems that

Ole Marsh, the wrestler, who made
Minot his headquarters for some time
seven years ago, has been sentenced
to the federal prison for 15 months
by Judge MePherscn of Council
Bluffs, la. Marsh was convicted of
Bert Shores, who joined Marsh
here, and1 became prominent in the
publi ceye by an attempted diamond
swindle in connection with a wrest
ling matih, was also given 15 months
by the judge.
Marsh was a clever wrestler but
was never known to play a square
