That It Is hereby de cided by the Council or tho City of Marlon three-fourths or all tho mem bers elected thereto concurring to proceed with the Improvement of Park Boulevard rrom Center Street lo the south lino of lot No. lcS8 lir accordance with a resolution for that purpose passed on tho ith day of March, 1007, by said Council and bo 'ng known as resolution No. 9; and In accordance with the plans, speci fications, estimates and profiles here tofore approved and now on fllo In tho office of tho department ot Public Service. Sec. 2. That all claims for dam ages therefrom shall bo Judicially in quired Into beforo tho commence ment of tho proposed Improvement, and the City Solicitor bo and ho Is hereby authorized mid directed to In stitute proceedings In a court of com petent jurisdiction to Inaulro Into such claims. Sec. 3. That tho wholo cost of said Improvement less ono-flftleth there of nnd, the cost of Intersection shall bo assessed by tho foot frontage upon all lots ami lnuds bounding nnd abut ting upon said Improvements between Center Street and tho south lino of lot No. 1088 which said lots and lands aro hereby determined to bo especially benefitted by said Improve ment; and tho cost ot said Improve ment shall Include the expense ot printing, publishing nnd serving not ices, resolutions, ordinances required, and the cost or Issuing tho samo Is sued in anticipation or tho collection of the assessment to bo levied for said improvement Interest and all other necessary expenditures. See. 4. That tho nsscssment bo to Ik) levied shall bo paid In ten annu al installments with interest on de ferred payments not to exceed six nor cent, per annum payable semi annually, provided that tho owner ot any property, may, at his option, pay such assessment or any number of Installments thereot at any time after said assessment has been lovled with Interest to tno seml-nnnual Interest day ot said bonds next following tho last, payment. Sec, 5. Bonds or notes of the City of Marlon, Ohio, shall bo Issued In anticipation or tho collection ot tho nsscssment by installments nnd In an amount equal thereto. See. C. That tho remainder of tho entlro cost ot snld Improvement shall he paid by tho Issuance of bonds In tho maimer provided by law. ' Sec. 7. That said improvement shall bo of vitrified brick block with eurh and tho necessary catch basins, drainage, etc., and tho following .materials may be bid upon therefor: Vitrified brick block. See. 8. That the Board ot Public Service bo and thoy aro hereby authorized nnd directed to make nndi oxecuto a contract for such Improve ment to tho lowest and best bidder after advertisement according to law.
